Section 142D.1, subsections 2 and 3, Code 2020, 3 are amended to read as follows: 4 2. The general assembly finds that environmental tobacco 5 smoke causes and exacerbates and electronic smoking devices 6 cause and exacerbate disease in nonsmoking adults and children. 7 These findings are sufficient to warrant measures that regulate 8 smoking in public places, places of employment, and outdoor 9 areas in order to protect the public health and the health of 10 employees. 11 3. The purpose of this chapter is to reduce the level of 12 exposure by the general public and employees to environmental 13 tobacco smoke and electronic smoking devices in order to 14 improve the public health of Iowans. 15 Sec. ___. Section 142D.2, Code 2020, is amended by adding 16 the following new subsection: 17 NEW SUBSECTION . 3A. “Electronic smoking device” means 18 any product containing or delivering nicotine or any other 19 substance intended for human consumption that can be used in 20 any manner by a person to create an aerosol or vapor. The term 21 includes any such product in any form, whether manufactured, 22 distributed, marketed, or sold as an e-cigarette, e-cigar, 23 e-pipe, e-hookah, or vape pen, or under any other product name 24 or descriptor. 25 Sec. ___. Section 142D.2, subsection 21, Code 2020, is 26 amended to read as follows: 27 21. “Smoking” means inhaling, exhaling, burning, or 28 carrying any lighted or heated cigar, cigarette, pipe, hookah, 29 or any other lighted or heated tobacco product or plant 30 product, whether natural or synthetic, in any manner or in any 31 form , including marijuana . “Smoking” includes the use of an 32 electronic smoking device. “Smoking” does not include smoking 33 that is associated with a recognized religious ceremony, 34 ritual, or activity, including but not limited to burning of 35 -1- SF2268.3515 (4) 88 pf/jh 1/ 2 #1.
