Moneys allocated under this lettered paragraph 2 may be used by the early childhood Iowa state board for the 3 purpose of skills development and support for ongoing training 4 of staff. However, except as otherwise provided in this 5 subsection, moneys shall not be used for additional staff or 6 for the reimbursement of staff. 7 b. Of the amount appropriated in this subsection for 8 deposit in the school ready children grants account of the 9 early childhood Iowa fund, $2,318,018 shall be used for efforts 10 to improve the quality of early care, health, and education 11 programs. Moneys allocated pursuant to this paragraph may be 12 used for additional staff and for the reimbursement of staff. 13 The early childhood Iowa state board may reserve a portion 14 of the allocation, not to exceed $88,650 for the technical 15 assistance expenses of the early childhood Iowa state office, 16 including the reimbursement of staff, and shall distribute 17 the remainder to early childhood Iowa areas for local quality 18 improvement efforts through a methodology identified by the 19 early childhood Iowa state board to make the most productive 20 use of the funding, which may include use of the distribution 21 formula, grants, or other means. 22 c. Of the amount appropriated in this subsection for 23 deposit in the school ready children grants account of 24 the early childhood Iowa fund, $825,030 shall be used for 25 support of professional development and training activities 26 for persons working in early care, health, and education by 27 the early childhood Iowa state board in collaboration with 28 the professional development component groups maintained by 29 the early childhood Iowa stakeholders alliance pursuant to 30 section 256I.12, subsection 7, paragraph “b”, and the early 31 childhood Iowa area boards. Expenditures shall be limited to 32 professional development and training activities agreed upon by 33 the parties participating in the collaboration. 34 9. The department may charge school districts and accredited 4 nonpublic schools a fee for the system not to exceed the actual 5 costs to purchase a statewide license for the early warning 6 assessment minus the moneys received by the department under 7 this subsection. The fee shall be determined by dividing the 8 actual remaining costs to purchase the statewide license for 9 the school year by the number of pupils assessed under the 10 system in the current fiscal year. School districts may use 11 moneys received pursuant to section 257.10, subsection 11, and 12 moneys received for purposes of implementing section 279.68, 13 subsection 2, to pay the early warning assessment system fee. 14 21. IOWA READING RESEARCH CENTER 15 a. For 7 the fiscal year beginning July 1, 2019, and ending June 30, 8 2020, the state board of regents may use notes, bonds, or 9 other evidences of indebtedness issued under section 262.48 to 10 finance projects that will result in energy cost savings in an 11 amount that will cause the state board to recover the cost of 12 the projects within an average of six years. 13 Sec. 11. PRESCRIPTION DRUG COSTS. Notwithstanding section 14 270.7, the department of administrative services shall pay 15 the state school for the deaf and the Iowa braille and sight 16 saving school the moneys collected from the counties during the 17 fiscal year beginning July 1, 2019, for expenses relating to 18 prescription drug costs for students attending the state school 19 for the deaf and the Iowa braille and sight saving school. 20 Sec. 12. Section 84A.1B, subsection 13A, as enacted by 21 2018 Iowa Acts, chapter 1067, section 7, is amended to read as 22 follows: 23 13A. Create, and update as necessary, a list of high-demand 24 jobs statewide for purposes of the future ready Iowa registered 25 apprenticeship development program created in section 15C.1 , 26 the summer youth intern pilot program established under section 27 84A.12 , the Iowa employer innovation program established 28 under section 84A.13 , the future ready Iowa skilled workforce 29 last-dollar scholarship program established under section 30 261.131 , the future ready Iowa skilled workforce grant program 31 established under section 261.132 , and postsecondary summer 32 classes for high school students as provided under section 33 261E.8, subsection 7A . In addition to the list created by 34 the workforce development board under this subsection , each 35 -20- HF758.1805 (3) 88 kh/tm 20/ 31
community college, in consultation with regional career 1 and technical education planning partnerships, and with the 2 approval of the board of directors of the community college, 3 may identify and maintain a list of not more than five regional 4 high-demand jobs in the community college region, and shall 5 share the lists with the workforce development board. The 6 lists submitted by community colleges under the subsection 7 may be used in that community college region for purposes of 8 programs identified under this subsection . The workforce 9 development board shall have full discretion to select and 10 prioritize statewide high-demand jobs after consulting with 11 business and education stakeholders, as appropriate, and 12 seeking public comment. The workforce development board may 13 add to the list of high-demand jobs as it deems necessary. For 14 purposes of this subsection , “high-demand job” means a job in 15 the state for which that the board, or a community college in 16 accordance with this subsection , determines work opportunities 17 are available and qualified applicants are lacking has 18 identified in accordance with this subsection . In creating a 19 list under this subsection, the workforce development board 20 shall use, at a minimum, the following criteria: 21 a. An entry-level wage of not less than fourteen dollars. 22 b. Educational attainment of a qualifying credential up to a 23 bachelor’s degree. 24 c. One or both of the following criteria: 25 (1) Projected annual job openings of at least two hundred 26 fifty or more during the next five years. 27 (2) Annual job growth of at least one percent. 28 Sec. 13. Section 261.25, subsections 1 and 2, Code 2019, are 29 amended to read as follows: 30 1. There is appropriated from the general fund of the state 31 to the commission for each fiscal year the sum of forty-six 32 forty-seven million six seven hundred thirty three thousand 33 nine four hundred fifty-one sixty-three dollars for tuition 34 grants to qualified students who are enrolled in accredited 35 -21- HF758.1805 (3) 88 kh/tm 21/ 31
private institutions. 1 2. There is appropriated from the general fund of the state 2 to the commission for each fiscal year the sum of three four 3 hundred seventy-six twenty-six thousand two hundred twenty 4 dollars for tuition grants for qualified students who are 5 enrolled in eligible institutions. Of the moneys appropriated 6 under this subsection , not more than eighty thousand dollars 7 annually shall be used for tuition grants to qualified students 8 who are attending an eligible institution under section 261.9, 9 subsection 3 , paragraph “b” . 10 Sec. 14. Section 261.86, subsection 1, unnumbered paragraph 11 1, Code 2019, is amended to read as follows: 12 A national guard educational assistance program service 13 scholarship is established to be administered by the college 14 student aid commission for members of the Iowa national guard 15 who are enrolled as undergraduate students in a community 16 college, an institution of higher learning under the state 17 board of regents, or an accredited private institution. The 18 college student aid commission shall adopt rules pursuant 19 to chapter 17A to administer this section . An individual 20 is eligible for the national guard educational assistance 21 service scholarship program if the individual meets all of the 22 following conditions: 23 Sec. 15. Section 261.86, subsection 1, paragraph a, Code 24 2019, is amended to read as follows: 25 a. Is a resident of the state and a member of an Iowa 26 army or air national guard unit while receiving educational 27 assistance scholarship award payments issued pursuant to this 28 section . 29 Sec. 16. Section 261.86, subsections 2, 3, 4, and 5, Code 30 2019, are amended to read as follows: 31 2. Educational assistance Scholarship awards paid pursuant 32 to this section shall not exceed the resident tuition rate 33 established for institutions of higher learning under 34 the control of the state board of regents. appropriated in a fiscal year for purposes of this section is 1 insufficient to provide educational assistance scholarships 2 to all national guard members who apply for the program and 3 who are determined by the adjutant general to be eligible 4 for the program, the adjutant general shall, in coordination 5 with the commission, determine the distribution of educational 6 assistance scholarships . However, educational assistance 7 scholarship awards paid pursuant to this section shall not 8 be less than fifty percent of the resident tuition rate 9 established for institutions of higher learning under the 10 control of the state board of regents or fifty percent of 11 the tuition rate at the institution attended by the national 12 guard member, whichever is lower. Neither eligibility nor 13 educational assistance scholarship award determinations shall 14 be based upon a national guard member’s unit, the location at 15 which drills are attended, or whether the eligible individual 16 is a member of the Iowa army or air national guard. 17 3. a. (1) An Except as provided in subparagraph (2), an 18 eligible member of the national guard, attending an institution 19 as provided in subsection 1 , paragraph “d” , shall not receive 20 educational assistance scholarship awards under this section 21 for more than one hundred twenty semester, or the equivalent, 22 credit hours of undergraduate study. 23 (2) An eligible member of the national guard, attending an 24 institution as provided in subsection 1, paragraph “d” , who is 25 enrolled in a program of education leading to a postsecondary 26 degree that meets the eligibility requirements for the federal 27 Edith Nourse Rogers STEM scholarship established under 38 28 U.S.C. §3320, shall not receive scholarship awards issued under 29 this section for more than one hundred thirty semester, or the 30 equivalent, credit hours of undergraduate study. 31 (3) A national guard member who has met the educational 32 requirements for a baccalaureate degree is ineligible for 33 educational assistance a scholarship award under this section . 34 b. A member of the national guard who received educational 35 -23- HF758.1805 (3) 88 kh/tm 23/ 31
assistance under this section prior to July 1, 2015, shall 1 be deemed to have received educational assistance for the 2 following number of credit hours for educational assistance 3 received before that date: 4 (1) For each semester that the member received educational 5 assistance while attending an institution as a full-time 6 student, twelve credit hours. 7 (2) For each semester that the member received educational 8 assistance while attending an institution as a part-time 9 student, six credit hours. 10 (3) For each trimester or quarter that the member received 11 educational assistance while attending an institution as a 12 full-time or part-time student, the number of credit hours that 13 are determined to be the semester equivalent by the college 14 student aid commission. 15 4. The eligibility of applicants and scholarship award 16 amounts of educational assistance to be paid shall be 17 certified by the adjutant general of Iowa to the college 18 student aid commission, and all amounts that are or become 19 due to a community college, accredited private institution, 20 or institution of higher learning under the control of the 21 state board of regents under this section shall be paid to the 22 college or institution by the college student aid commission 23 upon receipt of certification by the president or governing 24 board of the educational institution as to accuracy of charges 25 made, and as to the attendance and academic progress of the 26 individual at the educational institution. The college student 27 aid commission shall maintain an annual record of the number of 28 participants and the dollar value of the educational assistance 29 provided awards issued . 30 5. For purposes of this section , unless otherwise required, 31 “educational assistance” means the same as Scholarships awarded 32 under this section may be used by the recipient for the 33 recipient’s “cost of attendance” as defined in Tit. IV, pt. B, 34 of the federal Higher Education Act of 1965 as amended. 35 -24- HF758.1805 (3) 88 kh/tm 24/ 31
Sec. 17. Section 284.13, subsection 1, paragraphs a, b, c, 1 e, f, and g, Code 2019, are amended to read as follows: 2 a. For the fiscal year beginning July 1, 2018 2019 , and 3 ending June 30, 2019 2020 , to the department, the amount of 4 five hundred eight thousand two hundred fifty dollars for the 5 issuance of national board certification awards in accordance 6 with section 256.44 . Of the amount allocated under this 7 paragraph, not less than eighty-five thousand dollars shall 8 be used to administer the ambassador to education position in 9 accordance with section 256.45 . 10 b. For the fiscal year beginning July 1, 2018 2019 , and 11 ending June 30, 2019 2020 , up to seven hundred twenty-eight 12 thousand two hundred sixteen dollars to the department for 13 purposes of implementing the professional development program 14 requirements of section 284.6 , assistance in developing model 15 evidence for teacher quality committees established pursuant to 16 section 284.4, subsection 1 , paragraph “b” , and the evaluator 17 training program in section 284.10 . A portion of the funds 18 allocated to the department for purposes of this paragraph may 19 be used by the department for administrative purposes and for 20 not more than four full-time equivalent positions. 21 c. For the fiscal year beginning July 1, 2018 2019 , 22 and ending June 30, 2019 2020 , an amount up to one million 23 seventy-seven thousand eight hundred ten dollars to the 24 department for the establishment of teacher development 25 academies in accordance with section 284.6, subsection 10 . A 26 portion of the funds allocated to the department for purposes 27 of this paragraph may be used for administrative purposes. 28 e. For the fiscal year beginning July 1, 2018 2019 , and 29 ending June 30, 2019 2020 , to the department an amount up to 30 twenty-five thousand dollars for purposes of the fine arts 31 beginning teacher mentoring program established under section 32 256.34 . 33 f. For the fiscal year beginning July 1, 2018 2019 , and 34 ending June 30, 2019 2020 , to the department an amount up 35 -25- HF758.1805 (3) 88 kh/tm 25/ 31
to six hundred twenty-six thousand one hundred ninety-one 1 dollars shall be used by the department for a delivery system, 2 in collaboration with area education agencies, to assist in 3 implementing the career paths and leadership roles considered 4 pursuant to sections 284.15 , 284.16 , and 284.17 , including but 5 not limited to planning grants to school districts and area 6 education agencies, technical assistance for the department, 7 technical assistance for districts and area education agencies, 8 training and staff development, and the contracting of external 9 expertise and services. In using moneys allocated for purposes 10 of this paragraph, the department shall give priority to school 11 districts with certified enrollments of fewer than six hundred 12 students. A portion of the moneys allocated annually to the 13 department for purposes of this paragraph may be used by the 14 department for administrative purposes and for not more than 15 five full-time equivalent positions. 16 g. For the fiscal year beginning July 1, 2019 2020 , and 17 for each subsequent fiscal year, to the department, ten 18 million dollars for purposes of implementing the supplemental 19 assistance for high-need schools provisions of section 284.11 . 20 Annually, of the moneys allocated to the department for 21 purposes of this paragraph, up to one hundred thousand dollars 22 may be used by the department for administrative purposes and 23 for not more than one full-time equivalent position. 24 Sec. 18. EFFECTIVE DATE. The following, being deemed of 25 immediate importance, takes effect upon enactment: 26 1. The section of this Act amending 2017 Iowa Acts, chapter 27 172, section 50, subsection 5, as amended by 2018 Iowa Acts, 28 chapter 1163, section 4. 29 2. The department shall establish an 29 application process and criteria to award grants pursuant to 30 this subparagraph to community colleges. (4) From the moneys appropriated in this lettered paragraph 1 “b”, $210,000 shall be transferred to the department of human 2 services for purposes of administering a pilot project to 3 provide access to international resources to Iowans and new 4 Iowans to provide economic and leadership development resulting 5 in Iowa being a more inclusive and welcoming place to live, 6 work, and raise a family. The pilot project shall provide 7 supplemental support services for international refugees to 8 improve learning, English literacy, life skills, cultural 9 competencies, and integration in a county with a population 10 over 350,000 as determined by the 2010 federal decennial 11 census. The department of human services shall utilize a 12 request for proposals process to identify the entity best 13 qualified to implement the pilot project. 14 c. Notwithstanding section 8.33, moneys appropriated 21 in this section of this Act that remain unencumbered or 22 unobligated at the close of the fiscal year shall not revert 23 but shall remain available for expenditure for the purposes 24 designated until the close of the succeeding fiscal year. 25 Sec. 20. IOWA INDUSTRIAL NEW JOBS TRAINING ACT —— FY 26 2018-2019 DEFINITIONS. Notwithstanding section 260E.2, for 27 the fiscal year beginning July 1, 2018, and ending June 30, 28 2019, “new job” includes a new, existing, or recalled job 29 in an industry which, for purposes of this section, means 30 a business existing on the effective date of this section 31 and located in a county with a population between 40,500 and 32 41,000, as determined by the 2010 federal decennial census, 33 that was declared a disaster area by the governor following a 34 weather-related natural disaster which impacted the county on 35 -29- HF758.1805 (3) 88 kh/tm 29/ 31
or about July 19, 2018. 1 Sec. 21. Section 260I.2, subsection 2, paragraph c, Code 2 2019, is amended to read as follows: 3 c. Moneys Except as provided in section 260I.10, subsection 4 4, moneys in the fund shall be allocated pursuant to the 5 formula established in section 260C.18C . Notwithstanding 6 section 8.33 , moneys in the fund at the close of the fiscal 7 year shall not revert to the general fund of the state but 8 shall remain available for expenditure for the purpose 9 designated for subsequent fiscal years. Notwithstanding 10 section 12C.7, subsection 2 , interest or earnings on moneys in 11 the fund shall be credited to the fund. 12 Sec. 22. Section 260I.3, subsection 1, Code 2019, is amended 13 to read as follows: 14 1. The department state board of education, in consultation 15 with the economic development authority, shall adopt rules 16 pursuant to this chapter 17A defining eligibility criteria 17 for persons applying to receive tuition assistance under this 18 chapter . 19 Sec. 23. Section 260I.3, subsection 2, paragraph a, Code 20 2019, is amended to read as follows: 21 a. The applicant’s family income for the six three months 22 prior to the date of application or documentation of a 23 life-changing event . 24 Sec. 24. Section 260I.3, Code 2019, is amended by adding the 25 following new subsection: 26 NEW SUBSECTION . 6. The community college receiving the 27 application may limit an applicant to one eligible certificate 28 program or to eligible programs within one career pathway, 29 based on the funding available to the community college for 30 purposes of this program. 31 Sec. 25. Section 260I.4, subsection 4, Code 2019, is amended 32 by striking the subsection. 33 Sec. 26. Section 260I.7, Code 2019, is amended to read as 34 follows: 35 -30- HF758.1805 (3) 88 kh/tm 30/ 31
260I.7 Initial assessment. 1 An applicant for tuition assistance under this chapter shall 2 complete an initial assessment administered by the community 3 college receiving the application to determine the applicant’s 4 readiness to complete an eligible certificate program. The 5 assessment shall include assessments for completion of a 6 national career readiness certificate, including the areas of 7 reading for information, applied and mathematics , and locating 8 information . An applicant shall complete any additional 9 assessments and occupational research required by an eligible 10 certificate program. 11 Sec. 27. Section 260I.10, Code 2019, is amended by adding 12 the following new subsection: 13 NEW SUBSECTION . 4. The department of education, in 14 coordination with the community colleges, may adjust the 15 allocations generated pursuant to section 260I, subsection 2, 16 paragraph “c” , to ensure efficient delivery of services. 17 Sec. 28. Section 260I.11, Code 2019, is amended to read as 18 follows: 19 260I.11 Rules. 20 The department of state board of education, in consultation 21 with the economic development authority and the community 22 colleges, shall adopt rules pursuant to chapter 17A and this 23 chapter to implement the provisions of this chapter . 24 Sec. 29. EFFECTIVE DATE.
