WATER QUALITY INITIATIVE —— GENERAL. 17 1. The moneys appropriated in subsection 1 shall be 29 used to support projects in subwatersheds as designated by the 30 division that are part of high-priority watersheds identified 31 by the water resources coordinating council established 32 pursuant to section 466B.3 . 33 b. The moneys appropriated in subsection 1 shall be used to 34 support projects in watersheds generally, including regional 35 -4- SF609.1926.H (1) 88 md 4/ 24
watersheds, as designated by the division and high-priority 1 watersheds identified by the water resources coordinating 2 council established pursuant to section 466B.3. 3 3. In supporting projects in subwatersheds and watersheds 4 as provided in subsection 2, all of the following shall apply: 5 a. The demonstration projects shall utilize water quality 6 practices as described in the Iowa nutrient reduction strategy 7 as defined in section 455B.171 . 8 b. The division shall implement demonstration projects as 9 provided in paragraph “a” by providing for participation by 10 persons who hold a legal interest in agricultural land used in 11 farming. To every extent practical, the division shall provide 12 for collaborative participation by such persons who hold a 13 legal interest in agricultural land located within the same 14 subwatershed. 15 c. The division shall implement a demonstration project on 16 a cost-share basis as determined by the division. However, 17 except for edge-of-field practices, the state’s share of the 18 amount shall not exceed 50 percent of the estimated cost of 19 establishing the practice as determined by the division or 20 50 percent of the actual cost of establishing the practice, 21 whichever is less. 22 d. The demonstration projects shall be used to educate other 23 persons about the feasibility and value of establishing similar 24 water quality practices. The division shall promote field day 25 events for purposes of allowing interested persons to establish 26 water quality practices on their agricultural land. 27 e. The division shall conduct water quality evaluations 28 within supported subwatersheds. Within a reasonable period 29 after accumulating information from such evaluations, the 30 division shall create an aggregated database of water quality 31 practices. Any information identifying a person holding a 32 legal interest in agricultural land or specific agricultural 33 land shall be a confidential record under section 22.7 . 34 4. The moneys appropriated in subsection 1 shall be used 35 -5- SF609.1926.H (1) 88 md 5/ 24
to support education and outreach in a manner that encourages 1 persons who hold a legal interest in agricultural land used for 2 farming to implement water quality practices, including the 3 establishment of such practices in watersheds generally, and 4 not limited to subwatersheds or high-priority watersheds. 5 5. The moneys appropriated in subsection 1 may be used 6 to contract with persons to coordinate the implementation of 7 efforts provided in this section. 8 6. The moneys appropriated in subsection 1 may be used by 9 the department to support urban soil and water conservation 10 efforts, which may include but are not limited to management 11 practices related to bioretention, landscaping, the use of 12 permeable or pervious pavement, and soil quality restoration. 13 The moneys shall be allocated on a cost-share basis as provided 14 in chapter 161A. 15 7. Notwithstanding any other provision of law to the 16 contrary, the department may use moneys appropriated in 17 subsection 1 to carry out the provisions of this section on a 18 cost-share basis in combination with other moneys available to 19 the department from a state or federal source. 20 8. Not more than 10 percent of the moneys appropriated in 21 this section may be used to pay for the costs of administering 22 and implementing the water quality initiative by the 23 department’s division of soil conservation and water quality as 24 provided in section 466B.42 and this section. 25 DIVISION III 26 DEPARTMENT OF NATURAL RESOURCES 27 Sec. 9. GENERAL FUND —— DEPARTMENT. 28 1. There is appropriated from the general fund of the state 29 to the department of natural resources for the fiscal year 30 beginning July 1, 2019, and ending June 30, 2020, the following 31 amount, or so much thereof as is necessary, to be used for the 32 purposes designated: 33 For purposes of supporting the department, including its 34 divisions, for administration, regulation, and programs; for 35 -6- SF609.1926.H (1) 88 md 6/ 24

On June 30, 2020, any unencumbered or 9 unobligated moneys from the moneys allocated to support the 10 three full-time equivalent positions identified under this 11 subsection shall revert to the general fund of the state. 12 3. Of the number of full-time equivalent positions 13 authorized to the department pursuant to subsection 1, 50.00 14 full-time equivalent positions shall be allocated by the 15 department for seasonal employees for purposes of providing 16 maintenance, upkeep, and sanitary services at state parks. 17 This subsection shall not impact park ranger or park manager 18 positions within the department. 19 4. The department shall submit a report each quarter of the 20 fiscal year to the legislative services agency, the department 21 of management, the members of the joint appropriations 22 subcommittee on agriculture and natural resources, and the 23 chairpersons and ranking members of the senate and house 24 committees on appropriations. The report shall describe in 25 detail the expenditure of moneys appropriated under this 26 section to support the department’s administration, regulation, 27 and programs. 28 Sec. 10. STATE FISH AND GAME PROTECTION FUND —— REGULATION 29 AND ADVANCEMENT OF OUTDOOR ACTIVITIES. 30 1. There is appropriated from the state fish and game 31 protection fund created pursuant to section 456A.17 to the 32 department of natural resources for the fiscal year beginning 33 July 1, 2019, and ending June 30, 2020, the following amount, 34 or so much thereof as is necessary, to be used for the purposes 35 -7- SF609.1926.H (1) 88 md 7/ 24

Notwithstanding section 455A.10 , the department may use 9 the unappropriated balance remaining in the state fish and game 10 protection fund to provide for the funding of health and life 11 insurance premium payments from unused sick leave balances of 12 conservation peace officers employed in a protection occupation 13 who retire, pursuant to section 97B.49B . 14 3. Notwithstanding section 455A.10 , the department of 15 natural resources may use the unappropriated balance remaining 16 in the state fish and game protection fund for the fiscal 17 year beginning July 1, 2019, and ending June 30, 2020, as is 18 necessary to fund salary adjustments for departmental employees 19 for which the general assembly has made an operating budget 20 appropriation in subsection 1. 21 Sec. 11. GROUNDWATER PROTECTION FUND —— WATER 22 QUALITY. If by June 30, 2020, Iowa state university of science and 12 technology fails to allocate the moneys appropriated in this 13 section to the college of veterinary medicine in accordance 14 with this section, the moneys appropriated in this section for 15 that fiscal year shall revert to the general fund of the state. 16 DIVISION V 17 STATE UNIVERSITY OF IOWA 18 SPECIAL GENERAL FUND APPROPRIATIONS 19 FARM AND RURAL HEALTH 20 Sec. 17. IOWA’S CENTER FOR AGRICULTURAL SAFETY AND HEALTH 21 (I-CASH). 22 1. There is appropriated from the general fund of the state 23 to the state university of Iowa for the fiscal year beginning 24 July 1, 2019, and ending June 30, 2020, the following amount, 25 or so much thereof as is necessary, to be used for the purposes 26 designated: 27 For supporting the operations of Iowa’s center for 28 agricultural safety and health, as part of the university’s 29 college of public health, and in cooperation with the 30 department of agriculture and land stewardship, to anticipate, 31 recognize, and prevent occupational illness and injury among 32 members of the agricultural community: 33 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 130,000 34 2. the state university of Iowa shall retain the director of 1 Iowa’s center for agricultural safety and health employed on 2 the effective date of this Act for at least the same number of 3 hours for the fiscal year beginning July 1, 2019, as worked by 4 the director during the fiscal year beginning July 1, 2018. 5 Sec. 18. FARMERS WITH DISABILITIES PROGRAM. 6 1. There is appropriated from the general fund of the state 7 to the state university of Iowa for the fiscal year beginning 8 July 1, 2019, and ending June 30, 2020, the following amount, 9 or so much thereof as is necessary, to be used for the purposes 10 designated: 11 For purposes of supporting a program for farmers with 12 disabilities: 13 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 200,000 14 2. The moneys appropriated in subsection 1 shall be used for 15 the public purpose of providing a grant to a national nonprofit 16 organization with over 80 years of experience in assisting 17 children and adults with disabilities and special needs. The 18 moneys shall be used to support a nationally recognized program 19 that began in 1986 and has been replicated in at least 30 other 20 states, but which is not available through any other entity 21 in this state, and that provides assistance to farmers with 22 disabilities in all 99 counties to allow the farmers to remain 23 in their own homes and be gainfully engaged in farming through 24 provision of agricultural worksite and home modification 25 consultations, peer support services, services to families, 26 information and referral, and equipment loan services. 27 3. Notwithstanding section 8.33 , moneys appropriated in 28 this section that remain unencumbered or unobligated at the 29 close of the fiscal year shall not revert but shall remain 30 available for expenditure for the purposes designated until the 31 close of the succeeding fiscal year. 32 Sec. 19. USE OF MONEYS. 33 1. The state university of Iowa shall not reduce the amount 34 allocated to support Iowa’s center for agricultural safety or 35 -12- SF609.1926.H (1) 88 md 12/ 24
health or the program for farmers disabilities from any other 1 source due to the appropriation made in this division of this 2 Act. 3 2. If by June 30, 2020, the state university of Iowa fails 4 to use the moneys appropriated in a section of this division 5 of this Act in accordance with purposes and conditions of that 6 section, any unencumbered and unobligated moneys appropriated 7 in that section for the fiscal year beginning July 1, 2019, 8 and ending June 30, 2020, shall revert to the general fund 9 of the state. In addition, if moneys are required to be 10 reverted pursuant to this subsection, the state university of 11 Iowa shall transfer to the general fund from any otherwise 12 unencumbered and unobligated moneys from any other general 13 fund appropriation or from any moneys available from other 14 funding sources an amount equal to the amount appropriated in 15 the applicable section of this division of this Act less any 16 amount reverted to the general fund of the state pursuant to 17 this subsection. 18 DIVISION VI 19 ENVIRONMENT FIRST FUND 20 GENERAL APPROPRIATIONS 21 Sec. 20. DEPARTMENT OF AGRICULTURE AND LAND 22 STEWARDSHIP. There is appropriated from the environment first 23 fund created in section 8.57A to the department of agriculture 24 and land stewardship for the fiscal year beginning July 1, 25 2019, and ending June 30, 2020, the following amounts, or so 26 much thereof as is necessary, to be used for the purposes 27 designated: 28 1. CONSERVATION RESERVE ENHANCEMENT PROGRAM (CREP) 29 a. Notwithstanding section 8.33, moneys appropriated for 19 the fiscal year beginning July 1, 2019, in this division of 20 this Act to the department of agriculture and land stewardship 21 to provide financial assistance for the establishment of 22 permanent soil and water conservation practices that remain 23 unencumbered or unobligated at the close of the fiscal year 24 shall not revert but instead shall remain available for 25 expenditure for the purposes designated until the close of the 26 fiscal year beginning July 1, 2022. 27 2. Subsection 1 does not apply to moneys transferred 28 pursuant to this division to the loess hills development and 29 conservation fund created in section 161D.2 which shall not 30 revert as provided in that section. 31 DIVISION VII 32 ENVIRONMENT FIRST FUND 33 SPECIAL APPROPRIATIONS 34 Sec. 24. AGRICULTURE AND LAND STEWARDSHIP. 1 1. The moneys appropriated in subsection 1 shall be 14 used to support projects in subwatersheds as designated by the 15 division that are part of high-priority watersheds identified 16 by the water resources coordinating council established 17 pursuant to section 466B.3 . 18 b. The moneys appropriated in subsection 1 shall be used to 19 support projects in watersheds generally, including regional 20 watersheds, as designated by the division and high-priority 21 watersheds identified by the water resources coordinating 22 council established pursuant to section 466B.3. 23 3. In supporting projects in subwatersheds and watersheds 24 as provided in subsection 2, all of the following shall apply: 25 a. The demonstration projects shall utilize water quality 26 practices as described in the Iowa nutrient reduction strategy 27 as defined in section 455B.171 . 28 b. The division shall implement demonstration projects as 29 provided in paragraph “a” by providing for participation by 30 persons who hold a legal interest in agricultural land used in 31 farming. To every extent practical, the division shall provide 32 for collaborative participation by such persons who hold a 33 legal interest in agricultural land located within the same 34 subwatershed. 35 -19- SF609.1926.H (1) 88 md 19/ 24
c. The division shall implement a demonstration project on 1 a cost-share basis as determined by the division. However, 2 except for edge-of-field practices, the state’s share of the 3 amount shall not exceed 50 percent of the estimated cost of 4 establishing the practice as determined by the division or 5 50 percent of the actual cost of establishing the practice, 6 whichever is less. 7 d. The demonstration projects shall be used to educate other 8 persons about the feasibility and value of establishing similar 9 water quality practices. The division shall promote field day 10 events for purposes of allowing interested persons to establish 11 water quality practices on their agricultural land. 12 e. The division shall conduct water quality evaluations 13 within supported subwatersheds. Within a reasonable period 14 after accumulating information from such evaluations, the 15 division shall create an aggregated database of water quality 16 practices. Any information identifying a person holding a 17 legal interest in agricultural land or specific agricultural 18 land shall be a confidential record under section 22.7 . 19 4. The moneys appropriated in subsection 1 shall be used 20 to support education and outreach in a manner that encourages 21 persons who hold a legal interest in agricultural land used for 22 farming to implement water quality practices, including the 23 establishment of such practices in watersheds generally, and 24 not limited to subwatersheds or high-priority watersheds. 25 5. The moneys appropriated in subsection 1 may be used 26 to contract with persons to coordinate the implementation of 27 efforts provided in this section. 28 6. The moneys appropriated in subsection 1 may be used by 29 the department to support urban soil and water conservation 30 efforts, which may include but are not limited to management 31 practices related to bioretention, landscaping, the use of 32 permeable or pervious pavement, and soil quality restoration. 33 The moneys shall be allocated on a cost-share basis as provided 34 in chapter 161A. 35 -20- SF609.1926.H (1) 88 md 20/ 24
7. Notwithstanding any other provision of law to the 1 contrary, the department may use moneys appropriated in 2 subsection 1 to carry out the provisions of this section on a 3 cost-share basis in combination with other moneys available to 4 the department from a state or federal source. 5 8. Not more than 10 percent of the moneys appropriated in 6 this section may be used to pay for the costs of administering 7 and implementing the water quality initiative by the 8 department’s division of soil conservation and water quality as 9 provided in section 466B.42 and this section. 10 DIVISION VIII 11 IOWA RESOURCES ENHANCEMENT AND PROTECTION FUND 12 Sec. 25. REAP —— IN LIEU OF GENERAL FUND APPROPRIATION. In 13 lieu of the standing appropriation in section 455A.18 , there is 14 appropriated from the environment first fund created in section 15 8.57A to the Iowa resources enhancement and protection fund 16 for the fiscal year beginning July 1, 2019, and ending June 17 30, 2020, the following amount, to be allocated as provided in 18 section 455A.19 : 19 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 12,000,000 20 Sec. 26. Notwithstanding section 455A.19, 22 subsection 1 , paragraph “a”, subparagraph (1), of the moneys 23 allocated to the open spaces account of the Iowa resources 24 enhancement and protection fund, up to $1,000,000 may be 25 used by the department of natural resources for state park 26 maintenance and repair for the fiscal year beginning July 1, 27 2019, and ending on June 30, 2020. 28 Sec. 27. REAP —— OPEN SPACES ACCOUNT —— FLOOD DAMAGE REPAIR, 29 RESTORATION, OR REHABILITATION. 30 1. Notwithstanding section 455A.19, subsection 1, paragraph 31 “a”, subparagraph (1), of the moneys allocated to the open 32 spaces account of the Iowa resources enhancement and protection 33 fund, any amount in that account that is unencumbered and 34 unobligated on the effective date of this section, are 35 -21- SF609.1926.H (1) 88 md 21/ 24
appropriated to the department of natural resources for the 1 repair, restoration, or rehabilitation of property under the 2 jurisdiction or control of the department, including such 3 property located in southwestern Iowa, that has been damaged 4 by flood waters, for the fiscal year beginning July 1, 2018, 5 and ending June 30, 2019. 6 2. Nothing in this section requires the department to expend 7 any or a certain amount of moneys appropriated in subsection 1 8 for the purposes described in that subsection. 9 3. Notwithstanding section 8.33, moneys appropriated in 10 this section that remain unencumbered or unobligated at the 11 close of the fiscal year beginning July 1, 2018, and ending 12 June 30, 2019, shall not revert but shall remain available for 13 expenditure for the purposes designated until the close of the 14 succeeding fiscal year. 15 Sec. 28. EFFECTIVE DATE. The following, being deemed of 16 immediate importance, takes effect upon enactment: 17 1. The section of this division of this Act appropriating 18 moneys to the department of natural resources from moneys 19 allocated to the open spaces account of the Iowa resources 20 enhancement and protection fund for purposes of the repair, 21 restoration, or rehabilitation of property under the 22 jurisdiction or control of the department, for the fiscal year 23 beginning July 1, 2018, and ending June 30, 2019. 24 DIVISION IX 25 RELATED CODE CHANGES —— DEPARTMENT OF AGRICULTURE AND LAND 26 STEWARDSHIP —— PROGRAMS TO AUDIT MOTOR FUEL 27 Sec. 29.
