amended

read
as
follows:

2.
If
the
appropriation
of
a
department,
institution,
or
5
agency
is
insufficient
to
properly
meet
the
legitimate
expenses
6
of
the
department,
institution,
or
agency,
the
director,
with
7
the
approval
of
the
governor,
may
make
an
interdepartmental
8
transfer
from
any
other
department,
institution,
or
agency
9
of
the
state
having
an
appropriation
in
excess
of
its
needs,
10
of
sufficient
funds
to
meet
that
deficiency.
Such
transfer
11
shall
be
to
an
appropriation
made
from
the
same
funding
source
12
and
within
the
same
fiscal
year.
The
amount
of
a
transfer
13
made
from
an
appropriation
under
this
subsection
shall
be
14
limited
to
not
more
than
one-tenth
of
one
percent
of
the
15
total
of
all
appropriations
made
from
the
funding
source
of
16
the
transferred
appropriation
for
the
fiscal
year
in
which
17
the
transfer
is
made.
An
interdepartmental
transfer
to
an
18
appropriation
which
is
not
an
entitlement
appropriation
is
not
19
authorized
when
the
general
assembly
is
in
regular
session
20
and,
in
addition,
the
sum
of
interdepartmental
transfers
in
a
21
fiscal
year
to
an
appropriation
which
is
not
an
entitlement
22
appropriation
shall
not
exceed
fifty
percent
of
the
amount
of
23
the
appropriation
as
enacted
by
the
general
assembly.
For
24
the
purposes
of
this
subsection
,
an
entitlement
appropriation
25
is
a
line
item
appropriation
to
the
state
public
defender
26
for
indigent
defense
or
to
the
department
of
human
services
27
for
foster
care,
state
supplementary
assistance,
or
medical
28
assistance,
or
for
the
family
investment
program.
The
economic
29
development
authority
shall
not
make
an
interdepartmental
30
transfer
of
an
appropriation,
any
part
of
an
appropriation,
31
or
any
other
moneys,
to
the
Iowa
finance
authority.
The
Iowa
32
finance
authority
shall
not
make
an
interdepartmental
transfer
33
of
an
appropriation,
any
part
of
an
appropriation,
or
any
other
34
moneys,
to
the
economic
development
authority.
