Farm

Business

Disaster
Grant
Program.

1.
A
farm
and
small
business
disaster
grant
fund
is
created
10
in
the
state
treasury
under
the
control
of
the
economic
11
development
authority.
For
the
fiscal
year
beginning
July
1,
12
2018,
and
ending
June
30,
2019,
there
is
appropriated
from
the
13
general
fund
of
the
state
for
deposit
into
the
farm
and
small
14
business
disaster
grant
fund
the
amount
of
ten
million
dollars.

Moneys
in
the
fund
are
appropriated
to
the
authority
for
16
purposes
of
administering
the
farm
and
small
business
disaster
17
grant
program.

2.
Notwithstanding
section
8.33,
moneys
in
the
farm
and
19
small
business
disaster
grant
fund
at
the
close
of
each
fiscal
20
year
shall
not
revert
to
any
other
fund
but
shall
remain
in
the
21
fund
for
expenditure
for
subsequent
fiscal
years.

3.
From
the
moneys
appropriated
in
subsection
1,
the
23
authority
shall
provide
grants
of
one
thousand
dollars
per
24
month
per
the
number
of
employees
a
qualifying
farm
or
small
25
business
employs,
up
to
a
maximum
of
ten
thousand
dollars
per
26
month,
for
a
maximum
of
five
months,
for
qualifying
farms
and
27
small
businesses
affected
by
a
disaster.
Grants
shall
be
28
awarded
on
a
first-come,
first-served
basis.

4.
To
qualify
for
a
grant
pursuant
to
subsection
3,
a
farm
30
or
small
business
must
meet
all
of
the
following
requirements:

a.
The
farm
or
small
business
must
have
its
principal
32
place
of
business
located
in
a
county
that
has
been
declared
33
a
disaster
by
the
president
of
the
United
States
on
or
after
34
March
12,
2019.

The
disaster
must
have
caused
substantial
damage
to
the

farm
or
small
business.

c.
The
farm
or
small
business
must
have
had
to
temporarily

suspend
operations
or
have
been
dislocated
from
its
principal

place
of
business
due
to
the
disaster.

d.
The
farm
or
small
business
must
continue
to
employ
a
6
substantial
number
of
the
employees
that
the
farm
or
small
7
business
employed
before
the
disaster.

The
authority
may
adopt
rules
pursuant
to
chapter
17A
as
9
necessary
to
administer
this
section.

6.
The
authority
may
adopt
emergency
rules
under
section
11
17A.4,
subsection
3,
and
section
17A.5,
subsection
2,
paragraph
12
“b”
,
to
administer
the
provisions
of
this
section.
Any
rules
13
adopted
in
accordance
with
this
subsection
shall
also
be
14
published
as
a
notice
of
intended
action
as
provided
in
section
15
17A.4.

Sec.

EFFECTIVE
DATE.
This
division
of
this
Act,
being
17
deemed
of
immediate
importance,
takes
effect
upon
enactment.
