Section 272.2, subsection 14, paragraph b, 3 subparagraph (1), subparagraph division (b), Code 2019, is 4 amended by adding the following new subparagraph subdivision: 5 NEW SUBPARAGRAPH SUBDIVISION . (viii) Sexual exploitation 6 by a youth athletics coach. > 7 2. Page 1, by striking lines 10 through 13 and inserting 8 < coach shall be brought within five fifteen years of the date 9 the victim was last treated by the counselor or therapist, or 10 within five years of the date the victim was last enrolled in 11 or attended the school after the victim attains eighteen years 12 of age . > 13 3. Page 2, by striking lines 16 through 19 and inserting: 14 < b. Sexual exploitation by a youth athletics coach does not 15 include any of the following: 16 (1) Touching that is necessary in the performance of the 17 youth athletics coach’s duties including caring for an injured 18 athlete. 19 (2) Engaging in conduct in violation of subsection 3A, 20 paragraph “a” , subparagraph (2), with a student who is not more 21 than four years younger than the youth athletics coach and over 22 whom the youth athletics coach does not have direct authority. > 23 4. By striking page 2, line 28, through page 3, line 4, and 24 inserting: 25 < Sec. ___. Section 802.2A, Code 2019, is amended to read as 26 follows: 27 802.2A Incest —— sexual exploitation by a counselor, 28 therapist, or school employee , or youth athletics coach . 29 1. An information or indictment for incest under section 30 726.2 committed on or with a person who is under the age of 31 eighteen shall be found within ten fifteen years after the 32 person upon whom the offense is committed attains eighteen 33 years of age. An indictment or information for sexual exploitation by 1 a counselor, therapist, or school employee , or youth athletics 2 coach under section 709.15 committed on or with a person who 3 is under the age of eighteen shall be found within ten fifteen 4 years after the person upon whom the offense is committed 5 attains eighteen years of age.
