This division of this 4 Act takes effect on the effective date of rules prescribed by 5 the supreme court and submitted to the legislative council 6 pursuant to section 602.4202, that establish processes and 7 procedures for the application and issuance of a search warrant 8 by electronic means to implement 2017 Iowa Acts, chapter 37. 9 DIVISION ___ 10 RURAL IMPROVEMENT ZONES 11 Sec. ___. Section 357H.1, subsection 1, Code 2020, is 12 amended to read as follows: 13 1. The board of supervisors of a county with less than 14 twenty thousand residents, not counting persons admitted or 15 committed to an institution enumerated in section 218.1 or 16 904.102 , based upon the most recent certified federal census, 17 and with a private lake real estate development adjacent to or 18 abutting in part a lake may designate an area surrounding the 19 lake, if it is an unincorporated area of the county, a rural 20 improvement zone upon receipt of a petition pursuant to section 21 357H.2 , and upon the board’s determination that the area is in 22 need of improvements. 23 Sec. ___. EFFECTIVE DATE. This division of this Act, being 24 deemed of immediate importance, takes effect upon enactment. 25 Sec. ___. APPLICABILITY. This division of this Act applies 26 to rural improvement zones in existence on or established on or 27 after the effective date of this division of this Act. 28 DIVISION ___ 29 COUNTY ZONING 30 < Sec. ___. Section 335.8, subsection 1, Code 2020, as 31 amended by 2020 Iowa Acts, House File 2512, section 3, is 32 amended to read as follows: 33 1. In order to avail itself of the powers conferred by this 34 chapter , the board of supervisors shall appoint a commission 35 -3- H8294.4447 (3) 88 ns/tm 3/ 5
consisting of eligible electors, as defined in section 39.3, 1 who reside within the area regulated by the county zoning 2 ordinance county, but outside the corporate limits of any city , 3 to be known as the county zoning commission. The commission 4 may recommend the boundaries of the various districts and 5 appropriate regulations and restrictions to be enforced in 6 the districts. The commission shall, with due diligence, 7 prepare a preliminary report and hold public hearings on the 8 preliminary report before submitting the commission’s final 9 report. The board of supervisors shall not hold its public 10 hearings or take action until it has received the final report 11 of the commission. After the adoption of the regulations, 12 restrictions, and boundaries of districts, the zoning 13 commission may, from time to time, recommend to the board of 14 supervisors amendments, supplements, changes, or modifications. 15 The commission’s report and any recommendations may include a 16 proposed ordinance or amendments to an ordinance. 17 Sec. ___. Section 335.11, Code 2020, as amended by 2020 18 Iowa Acts, House File 2512, section 4, is amended to read as 19 follows: 20 335.11 Membership of board. 21 The board of adjustment shall consist of five members who 22 are eligible electors, as defined in section 39.3, and who 23 reside within the area regulated by the county zoning ordinance 24 county, but outside the corporate limits of any city , each to 25 be appointed for a term of five years, excepting that when the 26 board shall first be created one member shall be appointed for 27 a term of five years, one for a term of four years, one for a 28 term of three years, one for a term of two years, and one for 29 a term of one year. Members shall be removable for cause by 30 the appointing authority upon written charges and after public 31 hearing. Vacancies shall be filled for the unexpired term of 32 any member whose term becomes vacant. 33 Sec. ___. EFFECTIVE DATE.
