1.
For
purposes
of
this
section
and
section
26A.6,
“period
6
of
infectious
disease
emergency”
means
that
period
of
time

that
a
disease
or
virus
determined
to
be
life-threatening
to
8
a
person
exposed
to
the
disease
or
virus
has
been
declared
a
9
pandemic,
epidemic,
or
public
health
emergency
by
the
federal
10
government,
governor,
or
local
public
health
authorities.

2.
The
employer
of
an
employee
performing
work
during
a
12
period
of
infectious
disease
emergency
on
a
public
improvement
13
subject
to
a
guaranteed
maximum
price
contract
shall
provide
14
the
employee
with
a
supply
of
personal
protective
equipment,
15
including
but
not
limited
to
face
coverings
or
face
shields,
to
16
ensure
the
employee
is
not
exposed
to
the
disease
at
work.
The
17
employer
shall
promptly
replenish
the
supply
as
needed.

Infectious

——
insurance.
20
1.
During
a
period
of
infectious
disease
emergency,
an
21
employer
shall
provide
an
employee
performing
work
during
a
22
period
of
infectious
disease
emergency
on
a
public
improvement
23
subject
to
a
guaranteed
maximum
price
contract
a
minimum
of
24
fourteen
days
of
paid
sick
leave.

2.
During
a
period
of
infectious
disease
emergency,
an
26
employer
shall
provide
an
employee
performing
work
during
a
27
period
of
infectious
disease
emergency
on
a
public
improvement
28
subject
to
a
guaranteed
maximum
price
contract
a
minimum
of
29
twelve
weeks
of
family
and
medical
leave,
which
shall
not
run
30
concurrently
with
the
leave
provided
under
subsection
1,
to
31
provide
care
for
the
employee’s
spouse,
children,
or
parents
32
due
to
medical
conditions
resulting
from
the
disease.

3.
a.
The
insurance
commissioner
shall
establish
a
34
program
whereby
a
resident
of
this
state
who
performed
work

preceding
a

on
a
public
improvement
subject
to
a
guaranteed

price
contract,
whose
health
insurance

infectious

due
to
loss
of

employment,
and
who
chooses
to
obtain
health
care
continuation
5
coverage
pursuant
to
Tit.
I
of
the
federal
Employee
Retirement
6
Income
Security
Act
of
1974,
Pub.
L.
No.
93-406,
is
provided
7
with
a
monthly
subsidy
in
an
amount
necessary
to
cover
the
full
8
cost
for
which
the
resident
would
be
responsible
to
maintain
9
such
coverage
during
the
period.

b.
There
is
appropriated
annually
from
the
general
fund
11
of
the
state
to
the
insurance
division
of
the
department
12
of
commerce
from
funds
not
otherwise
appropriated
an
13
amount
necessary
to
pay
the
cost
of
such
subsidies
and
any
14
administrative
expenses
incurred
by
the
insurance
division
in
15
the
implementation
of
this
subsection.
16
c.
The
insurance
commissioner
may
use
any
available
source
17
of
federal
funding
to
cover
or
offset
the
cost
of
providing
18
subsidies
or
administering
the
program.
19
4.
a.
The
insurance
commissioner
shall
establish
a
20
program
to
provide
health
insurance
coverage
during
a
period
21
of
infectious
disease
emergency
to
any
resident
of
this
state
22
who
performed
work
during
or
immediately
preceding
a
period
of
23
infectious
disease
emergency
on
a
public
improvement
subject
to
24
a
guaranteed
maximum
price
contract
and
who
is
not
otherwise
25
able
to
obtain
such
coverage
under
another
provision
of
26
state
or
federal
law.
Such
coverage
shall
be
provided
at
no
27
cost
to
the
resident
and
shall,
at
minimum,
be
sufficient
to
28
provide
all
necessary
care
needed
due
to
contraction
of
the
29
disease,
aggravation
of
existing
medical
conditions
due
to
such
30
contraction,
or
onset
of
new
medical
conditions
other
than
the
31
disease
due
to
such
contraction.
Such
coverage
shall
allow
32
the
resident
to
obtain
medical
care
from
one
or
more
licensed
33
medical
professionals
of
the
resident’s
choice.

b.
There
is
appropriated
annually
from
the
general
fund

commerce

funds

otherwise

commissioner
