Section 514C.34, subsection 1, Code 2020, is 5 amended by adding the following new paragraphs: 6 NEW PARAGRAPH . 0a. “Covered person” means the same as 7 defined in section 514J.102. 8 NEW PARAGRAPH . 0c. “Health carrier” means the same as 9 defined in section 514J.102. 10 Sec. ___. Section 514C.34, Code 2020, is amended by adding 11 the following new subsection: 12 NEW SUBSECTION . 3A. A health carrier shall reimburse a 13 health care professional for health care services provided to 14 a covered person by telehealth on the same basis and at the 15 same rate as the health carrier would apply to the same health 16 care services provided to a covered person by the health care 17 professional in person. 18 Sec. ___. EFFECTIVE DATE. This division of this Act, being 19 deemed of immediate importance, takes effect upon enactment. 20 Sec. ___. APPLICABILITY. This division of this Act applies 21 to health care services provided by a health care professional 22 to a covered person by telehealth on or after March 9, 2020. 23 DIVISION VIII 24 FORECLOSURES, EVICTIONS, AND OTHER ACTIONS —— SUSPENSION 25 Sec. ___. FORECLOSURES, EVICTIONS, AND OTHER ACTIONS —— 26 SUSPENSION. 27 1. The general assembly finds that as the result of the 28 economic, health, and social conditions present in this state 29 related to the COVID-19 virus pandemic, emergency conditions 30 exist warranting the enactment and implementation of the 31 provisions of this division of this Act. 32 2. For the period of proclamation of disaster emergency 33 2020-32, issued March 9, 2020, relating to the COVID-19 34 virus, and any subsequent proclamation of disaster emergency 35 -1- SF2408.3816 (1) 88 ns/jh 1/ 4 #1.
relating to the COVID-19 virus issued by the governor pursuant 1 to section 29C.6, administrative, judicial, or other actions 2 seeking foreclosure, eviction, or repossession related to a 3 mortgage or security interest for residential real property 4 located in this state shall not be initiated or enforced until 5 after the specified disaster emergency proclamation time 6 period. For purposes of this section, “mortgage” means the 7 same as defined in section 16.1. 8 3. For the period of proclamation of disaster emergency 9 2020-32, issued March 9, 2020, relating to the COVID-19 10 virus, and any subsequent proclamation of disaster emergency 11 relating to the COVID-19 virus issued by the governor pursuant 12 to section 29C.6, administrative, judicial, or other actions 13 seeking eviction, repossession, or termination of a rental 14 agreement related to a rental agreement governed by chapter 15 562A or 562B shall not be initiated or enforced until after the 16 specified disaster emergency proclamation time period. 17 Sec. ___. EFFECTIVE DATE. This division of this Act, being 18 deemed of immediate importance, takes effect upon enactment. 19 Sec. ___. APPLICABILITY. This division of this Act applies 20 to actions related to mortgages, security instruments, and 21 rental agreements in effect on or entered into after the 22 effective date of this division of this Act. 23 DIVISION IX 24 UNEMPLOYMENT BENEFITS FOR EMPLOYEES DURING PROCLAMATION OF 25 DISASTER EMERGENCY —— COVID-19 VIRUS 26 Sec. ___. Section 96.4, Code 2020, is amended by adding the 27 following new subsection: 28 NEW SUBSECTION . 5A. a. Benefits based on service in 29 employment in any capacity compensated on an hourly basis 30 shall be paid to an individual for any week of unemployment 31 in the period of proclamation of disaster emergency 2020-32, 32 issued March 9, 2020, relating to the COVID-19 virus, and any 33 subsequent proclamation of disaster emergency relating to the 34 COVID-19 virus issued by the governor pursuant to section 35 -2- SF2408.3816 (1) 88 ns/jh 2/ 4
29C.6, if such unemployment is the result of an individual 1 being infected with the COVID-19 virus or quarantined due to 2 possible infection; the individual providing care for a family 3 member infected with the COVID-19 virus or quarantined due 4 to possible infection; or the individual’s employment being 5 terminated due to the economic impact of the COVID-19 virus on 6 the individual’s employer. 7 b. Benefits described in paragraph “a” are otherwise payable 8 in the same amount, on the same terms, and subject to the same 9 conditions as compensation payable on the same basis of other 10 service subject to this chapter. 11 c. For purposes of this subsection, “economic impact of the 12 COVID-19 virus on the individual’s employer” includes an employer 13 that goes out of business; the factory, establishment, or 14 other premises at which an individual is employed going out of 15 business; or the layoff of the individual, if such activities 16 result from the economic impact of the COVID-19 virus. 17 Sec. ___. IMPLEMENTATION OF ACT. Section 25B.2, subsection 18 3, shall not apply to this division of this Act. 19 Sec. ___. EMERGENCY RULES. The department of workforce 20 development shall adopt emergency rules under section 17A.4, 21 subsection 3, and section 17A.5, subsection 2, paragraph “b”, 22 to implement the provisions of this division of this Act and 23 the rules shall be effective immediately upon filing unless 24 a later date is specified in the rules. Any rules adopted 25 in accordance with this section shall also be published as a 26 notice of intended action as provided in section 17A.4. 27 Sec. ___. EFFECTIVE DATE. This division of this Act, being 28 deemed of immediate importance, takes effect upon enactment. 29 Sec. ___. RETROACTIVE APPLICABILITY. This division 30 of this Act applies retroactively beginning with any week 31 of unemployment in the period of proclamation of disaster 32 emergency 2020-32, issued March 9, 2020, relating to the 33 COVID-19 virus. An individual may retroactively submit a claim 34 for unemployment benefits for such a week in accordance with 35 -3- SF2408.3816 (1) 88 ns/jh 3/ 4
