NEW SECTION . 80.7 Peace officers —— health 4 insurance. 5 1. a. Notwithstanding any provision to the contrary, 6 peace officers employed within the department that are not 7 covered under a collective bargaining agreement who were at 8 any time eligible to be enrolled in the group health insurance 9 plan that is negotiated under chapter 20 between the state 10 and the state police officers council labor union and who 11 elect to participate in a group health insurance plan provided 12 by the state, shall only be permitted, if not prohibited to 13 participate pursuant to subsection 2, to participate in the 14 group health insurance plan that is negotiated under chapter 20 15 between the state and the state police officers council labor 16 union for peace officers subject to the requirements of this 17 section. In addition, a peace officer who was covered under 18 a collective bargaining agreement and who becomes a manager 19 or supervisor and is no longer covered by the agreement shall 20 not lose group health insurance benefits as provided by the 21 agreement. 22 b. Notwithstanding any provision to the contrary, peace 23 officers participating in the group health insurance plan 24 pursuant to paragraph “a” shall have the option, upon 25 retirement, to continue participation in the group health 26 insurance plan pursuant to section 509A.13 subject to the 27 requirements of this section. In addition, a retired peace 28 officer who was not covered under a collective bargaining 29 agreement and not eligible to participate in the group health 30 insurance plan as provided by this section shall have the 31 option, until December 31, 2020, to participate in the group 32 health insurance plan as provided by this section pursuant to 33 section 509A.13 subject to the requirements of this section. 34 An election by a retired peace officer to participate in the 35 -1- HF2549.3763 (1) 88 ec/rn 1/ 4 #1.

By September 1, 2020, and by September 1 of each year 3 thereafter, the governing body of the state police officers 4 council shall have the right to offer or terminate the ability 5 to participate in the group health insurance plan provided 6 by this subsection for the subsequent calendar year and 7 shall provide written notice of the council’s decision to the 8 department by September 1. The Iowa state patrol supervisors 9 association shall have the opportunity to address the governing 10 board of the state police officers council concerning the 11 decision of the governing board under this subsection on or 12 after July 1 but before September 1 of each calendar year. 13 Sec. 2. NEW SECTION . 456A.13A Full-time officers —— health 14 insurance. 15 1. a. Notwithstanding any provision to the contrary, 16 full-time officers as defined in section 456A.13 that are not 17 covered under a collective bargaining agreement who were at 18 any time eligible to be enrolled in the group health insurance 19 plan that is negotiated under chapter 20 between the state 20 and the state police officers council labor union and who 21 elect to participate in a group health insurance plan provided 22 by the state, shall only be permitted, if not prohibited to 23 participate pursuant to subsection 2, to participate in the 24 group health insurance plan that is negotiated under chapter 25 20 between the state and the state police officers council 26 labor union for full-time officers subject to the requirements 27 of this subsection. In addition, a full-time officer who 28 was covered under a collective bargaining agreement and who 29 becomes a manager or supervisor and is no longer covered by 30 the agreement shall not lose group health insurance benefits 31 as provided by the agreement. 32 b. Prior to July 1 of each calendar 21 year, the provider of the group health insurance plan 22 negotiated under chapter 20 between the state and the state 23 police officers council labor union shall submit a report 24 to the state police officers council and the departments of 25 public safety and natural resources necessary for purposes of 26 complying with the requirements of sections 80.7 and 456A.13A. 27 The report shall include usage statistics that separately 28 account for employees in the group health insurance plan 29 covered by a collective bargaining agreement negotiated by the 30 state police officers council and those employees that are 31 not covered by a collective bargaining agreement and shall 32 include any information that led to any premium rate increase 33 or decrease for the following calendar year. > 34 2.
