NEW SECTION . 80.7 Peace officers —— health 4 insurance. 5 1. a. (1) Notwithstanding any provision to the contrary, 6 peace officers employed within the department that are not 7 covered under a collective bargaining agreement who were at 8 any time eligible to be enrolled in the group health insurance 9 plan that is negotiated under chapter 20 between the state 10 and the state police officers council labor union and who 11 elect to participate in a group health insurance plan provided 12 by the state, shall only be permitted, if not prohibited to 13 participate pursuant to paragraph “b” , to participate in the 14 group health insurance plan that is negotiated under chapter 20 15 between the state and the state police officers council labor 16 union for peace officers subject to the requirements of this 17 subsection. In addition, a peace officer who was covered under 18 a collective bargaining agreement and who becomes a manager 19 or supervisor and is no longer covered by the agreement shall 20 not lose group health insurance benefits as provided by the 21 agreement. 22 (2) Notwithstanding any provision to the contrary, a peace 23 officer who was not covered under a collective bargaining 24 agreement shall not be allowed to participate in the group 25 health insurance plan negotiated under chapter 20 between the 26 state and the state police officers council upon retirement. 27 b. By September 1, 2020, and by September 1 of each year 28 thereafter, the governing body of the state police officers 29 council shall have the right to offer or terminate the ability 30 to participate in the group health insurance plan provided 31 by this subsection for the subsequent calendar year and 32 shall provide written notice of the council’s decision to the 33 department by September 1. board of the state police officers council concerning the 1 decision of the governing board under this paragraph on or 2 after July 1 but before September 1 of each calendar year. 3 2. The department shall be authorized to retain any savings 4 to the department for peace officers participating in the group 5 health insurance plan pursuant to subsection 1 from moneys 6 appropriated to the department. 7 Sec. 2. NEW SECTION . 456A.13A Full-time officers —— health 8 insurance. 9 1. a. (1) Notwithstanding any provision to the contrary, 10 full-time officers as defined in section 456A.13 that are not 11 covered under a collective bargaining agreement who were at 12 any time eligible to be enrolled in the group health insurance 13 plan that is negotiated under chapter 20 between the state 14 and the state police officers council labor union and who 15 elect to participate in a group health insurance plan provided 16 by the state, shall only be permitted, if not prohibited to 17 participate pursuant to paragraph “b” , to participate in the 18 group health insurance plan that is negotiated under chapter 19 20 between the state and the state police officers council 20 labor union for full-time officers subject to the requirements 21 of this subsection. In addition, a full-time officer who 22 was covered under a collective bargaining agreement and who 23 becomes a manager or supervisor and is no longer covered by 24 the agreement shall not lose group health insurance benefits 25 as provided by the agreement. 26 (2) Notwithstanding any provision to the contrary, a 27 full-time officer who was not covered under a collective 28 bargaining agreement shall not be allowed to participate in 29 the group health insurance plan negotiated under chapter 20 30 between the state and the state police officers council upon 31 retirement. 32 b. The department shall calculate the savings to the 5 department for full-time officers employed in the law 6 enforcement bureau of the department who are participating in 7 the group health insurance plan pursuant to subsection 1. The 8 department shall transfer to the state fish and game protection 9 fund created in section 456A.17 from moneys appropriated to the 10 department an amount equal to the savings calculated by the 11 department. 12 Sec. 3. GROUP HEALTH INSURANCE PLAN REPORTING —— STATE 13 POLICE OFFICERS COUNCIL. Prior to July 1 of each calendar 14 year, the provider of the group health insurance plan 15 negotiated under chapter 20 between the state and the state 16 police officers council labor union shall submit a report 17 to the state police officers council and the departments of 18 public safety and natural resources necessary for purposes of 19 complying with the requirements of sections 80.7 and 456A.13A. 20 The report shall include usage statistics that separately 21 account for employees in the group health insurance plan 22 covered by a collective bargaining agreement negotiated by the 23 state police officers council and those employees that are 24 not covered by a collective bargaining agreement and shall 25 include any information that led to any premium rate increase 26 or decrease for the following calendar year. > 27 2.
