Section 97B.50, subsection 2, paragraphs a and 3 b, Code 2020, are amended to read as follows: 4 a. A vested member who retires from the retirement system 5 due to disability and commences receiving disability benefits 6 pursuant to the federal Social Security Act, 42 U.S.C. §423 et 7 seq., and who has not reached the normal retirement date, shall 8 receive benefits as selected under section 97B.51 , and shall 9 not have benefits reduced upon retirement as required under 10 subsection 1 regardless of whether the member has completed 11 thirty or more years of membership service. However, the 12 benefits under this subsection shall be suspended during any 13 period in which the member returns to covered employment and is 14 no longer eligible for disability benefits under the federal 15 Social Security Act . This section takes effect July 1, 1990, 16 for a member meeting the requirements of this paragraph who 17 retired from the retirement system at any time after July 4, 18 1953. Eligible members retiring on or after July 1, 2000, are 19 entitled to the receipt of retroactive adjustment payments for 20 no more than thirty-six months immediately preceding the month 21 in which written application for retirement due to disability 22 was received by the system. 23 b. A vested member who retires from the retirement system 24 due to disability and commences receiving disability benefits 25 pursuant to the federal Railroad Retirement Act, 45 U.S.C. §231 26 et seq., and who has not reached the normal retirement date, 27 shall receive benefits as selected under section 97B.51 , and 28 shall not have benefits reduced upon retirement as required 29 under subsection 1 regardless of whether the member has 30 completed thirty or more years of membership service. However, 31 the benefits under this subsection shall be suspended during 32 any period in which the member returns to covered employment 33 and is no longer eligible for disability benefits under the 34 federal Railroad Retirement Act .
