Gas
and
electric
utilities
required
to
be

under

chapter
may
request
an
energy

efficiency
plan
or
demand
response
plan
modification
during
the

course
of
a
five-year
plan.
A
modification
may
be
requested

due
to
changes
in
funding
as
a
result
of
public
utility
10
customers
requesting
exemptions
from
the
plan
or
for
any
other
11
reason
identified
by
the
gas
or
electric
utility.
The
board
12
shall
take
action
on
a
modification
request
made
by
a
gas
or
13
electric
utility
within
ninety
days
after
the
modification
14
request
is
filed.
If
the
board
fails
to
take
action
within
15
ninety
days
after
a
modification
request
is
filed,
the
16
modification
request
shall
be
deemed
approved.

amended
to
read

The
board
shall
approve,
reject,
or
modify
a
plan
filed

to

subsection
no
later
than
March
31,
2019.
If

the
board
fails
to
approve,
reject,
or
modify
a
plan
filed
by
a

gas
or
electric
utility
on
or
before
such
date,
any
plan
filed
23
by
the
gas
or
electric
utility
that
was
approved
by
the
board
24
prior
to
May
4,
2018,
shall
be
terminated.
The
board
shall
25
not
require
or
allow
a
gas
or
electric
utility
to
implement
an
26
energy
efficiency
plan
or
demand
response
plan
that
does
not
27
meet
the
requirements
of
this
subsection
.

Board
action
on
filings
——
cost
of

living
rate
cap.
Notwithstanding
any
other
provision
of
law
to

the
contrary,
the
board
shall
not
be
required
to
take
action
on

any
filing
under
this
chapter
within
a
specific
time
period
and
34
shall
be
allotted
any
time
period
which
the
board
determines

appropriate
to
make
a
final

determination
on
such
filing.
Upon
the
review
of
any
requested

change

rate

maintain
a
rate
which
does
not
exceed
a

of
living
