GOALS AND ACCOUNTABILITY —— ECONOMIC DEVELOPMENT. 25 1. For the fiscal year beginning July 1, 2019, the goals 26 for the economic development authority shall be to expand and 27 stimulate the state economy, increase the wealth of Iowans, and 28 increase the population of the state. 29 2. To achieve the goals in subsection 1, the economic 30 development authority shall do all of the following for the 31 fiscal year beginning July 1, 2019: 32 a. Concentrate its efforts on programs and activities that 33 result in commercially viable products and services. 34 b. Adopt practices and services consistent with free 35 -2- SF608.2276 (1) 88 ko/tm 2/ 21
market, private sector philosophies. 1 c. Ensure economic growth and development throughout the 2 state. 3 d. Work with businesses and communities to continually 4 improve the economic development climate along with the 5 economic well-being and quality of life for Iowans. 6 e. Coordinate with other state agencies to ensure that they 7 are attentive to the needs of an entrepreneurial culture. 8 f. Establish a strong and aggressive marketing image to 9 showcase Iowa’s workforce, existing industry, and potential. 10 A priority shall be placed on recruiting new businesses, 11 business expansion, and retaining existing Iowa businesses. 12 Emphasis shall be placed on entrepreneurial development through 13 helping entrepreneurs secure capital, and developing networks 14 and a business climate conducive to entrepreneurs and small 15 businesses. 16 g. Encourage the development of communities and quality of 17 life to foster economic growth. 18 h. Prepare communities for future growth and development 19 through development, expansion, and modernization of 20 infrastructure. 21 i. Develop public-private partnerships with Iowa businesses 22 in the tourism industry, Iowa tour groups, Iowa tourism 23 organizations, and political subdivisions in this state to 24 assist in the development of advertising efforts. 25 j. Develop, to the fullest extent possible, cooperative 26 efforts for advertising with contributions from other sources. 27 Sec. 3. ECONOMIC DEVELOPMENT AUTHORITY. 28 1. APPROPRIATION 29 a. (1) For salaries, support, miscellaneous purposes, 3 programs, marketing, and the maintenance of an administration 4 division, a business development division, a community 5 development division, a small business development division, 6 and other divisions the authority may organize. 7 (2) The full-time equivalent positions authorized under 8 this section are funded, in whole or in part, by the moneys 9 appropriated under this subsection or by other moneys received 10 by the authority, including certain federal moneys. 11 (3) For business development operations and programs, 12 international trade, export assistance, workforce recruitment, 13 and the partner state program. 14 (4) For transfer to a fund created pursuant to section 15 15.313 for purposes of financing strategic infrastructure 16 projects. 17 (5) For community economic development programs, tourism 18 operations, community assistance, plans for Iowa green corps 19 and summer youth programs, the mainstreet and rural mainstreet 20 programs, the school-to-career program, the community 21 development block grant, and housing and shelter-related 22 programs. 23 (6) For achieving the goals and accountability, and 24 fulfilling the requirements and duties required under this Act. 25 c. Notwithstanding section 8.33, moneys appropriated in 26 this subsection that remain unencumbered or unobligated at the 27 close of the fiscal year shall not revert but shall remain 28 available for expenditure for the purposes designated in this 29 subsection until the close of the succeeding fiscal year. 30 2. FINANCIAL ASSISTANCE RESTRICTIONS 31 a. A business creating jobs through moneys appropriated in 32 subsection 1 shall be subject to contract provisions requiring 33 new and retained jobs to be filled by individuals who are 34 citizens of the United States who reside within the United 35 -4- SF608.2276 (1) 88 ko/tm 4/ 21
States or any person authorized to work in the United States 1 pursuant to federal law, including legal resident aliens in the 2 United States. 3 b. Any vendor who receives moneys appropriated in 4 subsection 1 shall adhere to such contract provisions and 5 provide periodic assurances as the state shall require that the 6 jobs are filled solely by citizens of the United States who 7 reside within the United States or any person authorized to 8 work in the United States pursuant to federal law, including 9 legal resident aliens in the United States. 10 c. A business that receives financial assistance from 11 the authority from moneys appropriated in subsection 1 shall 12 only employ individuals legally authorized to work in this 13 state. In addition to all other applicable penalties provided 14 by current law, all or a portion of the assistance received 15 by a business which is found to knowingly employ individuals 16 not legally authorized to work in this state is subject to 17 recapture by the authority. 18 3. USES OF APPROPRIATIONS 19 a. From the moneys appropriated in subsection 1, the 20 authority may provide financial assistance in the form of a 21 grant to a community economic development entity for conducting 22 a local workforce recruitment effort designed to recruit former 23 citizens of the state and former students at colleges and 24 universities in the state to meet the needs of local employers. 25 b. From the moneys appropriated in subsection 1, the 26 authority may provide financial assistance to early stage 27 industry companies being established by women entrepreneurs. 28 c. From the moneys appropriated in subsection 1, the 29 authority may provide financial assistance in the form of 30 grants, loans, or forgivable loans for advanced research and 31 commercialization projects involving value-added agriculture, 32 advanced technology, or biotechnology. 33 d. The authority shall not use any moneys appropriated in 34 subsection 1 for purposes of providing financial assistance for 35 -5- SF608.2276 (1) 88 ko/tm 5/ 21
the Iowa green streets pilot project or for any other program 1 or project that involves the installation of geothermal systems 2 for melting snow and ice from streets or sidewalks. 3 4. WORLD FOOD PRIZE 4 There is appropriated from the general fund of the state 5 to the economic development authority for the fiscal year 6 beginning July 1, 2019, and ending June 30, 2020, the following 7 amount for the world food prize and in lieu of the standing 8 appropriation in section 15.368 : 9 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 375,000 10 5. The authority shall adopt rules pursuant to chapter 14 17A to establish criteria for the distribution of the moneys 15 appropriated in this subsection. 16 Sec. 4. LIMITATIONS OF STANDING APPROPRIATIONS —— FY 17 2019-2020. Notwithstanding the standing appropriations 18 in the following designated sections for the fiscal year 19 beginning July 1, 2019, and ending June 30, 2020, the amounts 20 appropriated from the general fund of the state pursuant to 21 these sections for the following purposes shall not exceed the 22 following amounts: 23 1. FINANCIAL ASSISTANCE REPORTING —— ECONOMIC 31 DEVELOPMENT AUTHORITY. The economic development authority and 32 the department of revenue shall submit a joint annual report 33 to the general assembly no later than November 1, 2019, that 34 details the amount of every direct loan, forgivable loan, 35 -9- SF608.2276 (1) 88 ko/tm 9/ 21
tax credit, tax exemption, tax refund, grant, or any other 1 financial assistance awarded to a person during the prior 2 fiscal year by the authority under an economic development 3 program administered by the authority. The report shall 4 identify the county where the project associated with each such 5 award is located. 6 Sec. 6. INSURANCE ECONOMIC DEVELOPMENT. From the 7 moneys collected by the insurance division in excess of the 8 anticipated gross revenues under section 505.7, subsection 9 3 , during the fiscal year beginning July 1, 2019, $100,000 10 shall be transferred to the economic development authority for 11 insurance economic development and international insurance 12 economic development. 13 Sec. 7. IOWA FINANCE AUTHORITY. 14 1. There is appropriated from the general fund of the state 15 to the Iowa finance authority for the fiscal year beginning 16 July 1, 2019, and ending June 30, 2020, the following amount, 17 or so much thereof as is necessary, to be used to provide 18 reimbursement for rent expenses to eligible persons under 19 the home and community-based services rent subsidy program 20 established in section 16.55: 21 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 658,000 22 2. $100 filing fee for workers’ compensation cases. The filing 1 fee shall be paid by the petitioner of a claim. However, the 2 fee can be taxed as a cost and paid by the losing party, except 3 in cases where it would impose an undue hardship or be unjust 4 under the circumstances. The moneys generated by the filing 5 fee allowed under this subsection are appropriated to the 6 department of workforce development to be used for purposes of 7 administering the division of workers’ compensation. 8 3. WORKFORCE DEVELOPMENT OPERATIONS 9 a. section 96.9, subsection 4 , paragraph “a”, moneys credited to 1 the state by the secretary of the treasury of the United 2 States pursuant to section 903 of the Social Security 3 Act are appropriated to the department of workforce 4 development and shall be used by the department for the 5 administration of the unemployment compensation program only. 6 This appropriation shall not apply to any fiscal year 7 beginning after December 31, 2019. 8 Sec. 17. IOWA SKILLED WORKER AND JOB CREATION FUND. 9 1. There is appropriated from the Iowa skilled worker and 10 job creation fund created in section 8.75 to the following 11 departments, agencies, and institutions for the fiscal year 12 beginning July 1, 2019, and ending June 30, 2020, the following 13 amounts, or so much thereof as is necessary, to be used for the 14 purposes designated: 15 a. The report shall be provided in an 17 electronic format and shall include a list of metrics and 18 criteria mutually agreed to in advance by the board of regents 19 and the economic development authority. The metrics and 20 criteria shall allow the governor’s office and the general 21 assembly to quantify and evaluate the progress of the board of 22 regents institutions with regard to their activities, projects, 23 and programs in the areas of technology commercialization, 24 entrepreneurship, regional development, and market research. 25 (2) IOWA STATE UNIVERSITY OF SCIENCE AND TECHNOLOGY. The match required of 18 small businesses as defined in section 15.102, subsection 8, 19 for directed contract research or for nondirected research 20 shall be $1 for each $3 of state funds. The match required 21 for other businesses for directed contract research or 22 for nondirected research shall be $1 for each $1 of state 23 funds. Section 16.2, Code 2019, is amended by adding the 6 following new subsection: 7 NEW SUBSECTION . 2A. There shall be four ex officio, 8 nonvoting legislative members consisting of the following: 9 a. Two state senators, one appointed by the majority leader 10 of the senate and one appointed by the minority leader of the 11 senate from their respective parties. 12 b. Two state representatives, one appointed by the speaker 13 and one appointed by the minority leader of the house of 14 representatives from their respective parties. 15 Sec. 20. Section 16.2, subsection 3, Code 2019, is amended 16 to read as follows: 17 3. Five voting members of the authority constitute a quorum 18 and the affirmative vote of a majority of the appointed members 19 is necessary for any substantive action taken by the authority. 20 The majority shall not include any member who has a conflict of 21 interest and a statement by a member of a conflict of interest 22 shall be conclusive for this purpose.
