By striking everything after the enacting clause and 3 inserting: 4 < DIVISION I 5 REBUILD IOWA INFRASTRUCTURE FUND 6 Section 1. REBUILD IOWA INFRASTRUCTURE FUND —— 7 APPROPRIATIONS. There is appropriated from the rebuild Iowa 8 infrastructure fund to the following departments and agencies 9 for the following fiscal years, the following amounts, or so 10 much thereof as is necessary, to be used for the purposes 11 designated: 12 1. DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP 13 a. (1) For deposit in the water quality initiative fund 14 created in section 466B.45 for purposes of supporting the 15 water quality initiative administered by the division of soil 16 conservation and water quality as provided in section 466B.42 , 17 including salaries, support, maintenance, and miscellaneous 18 purposes, notwithstanding section 8.57, subsection 5 , paragraph 19 “c”: 20 FY 2019-2020: 21 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 5,200,000 22 (2) (a) The moneys appropriated in this lettered 23 paragraph shall be used to support demonstration projects in 24 subwatersheds as designated by the department that are part 25 of high-priority watersheds identified by the water resources 26 coordinating council. 27 (b) The moneys appropriated in this lettered paragraph 28 shall be used to support demonstration projects in watersheds 29 generally, including regional watersheds, as designated by the 30 division and high-priority watersheds identified by the water 31 resources coordinating council. 32 (3) In supporting projects in watersheds and subwatersheds 33 as provided in subparagraph (2), subparagraph divisions (a) and 34 (b), all of the following shall apply: 35 -1- HF765.2269.S (1) 88 mb 1/ 19 #1.
(a) The demonstration projects shall utilize water quality 1 practices as described in the latest revision of the document 2 entitled “Iowa Nutrient Reduction Strategy” initially presented 3 in November 2012 by the department of agriculture and land 4 stewardship, the department of natural resources, and Iowa 5 state university of science and technology. 6 (b) The division shall implement demonstration projects 7 as provided in subparagraph division (a) by providing 8 for participation by persons who hold a legal interest in 9 agricultural land used in farming. To every extent practical, 10 the division shall provide for collaborative participation by 11 such persons who hold a legal interest in agricultural land 12 located within the same subwatershed. 13 (c) The division shall implement demonstration projects on 14 a cost-share basis as determined by the division. Except for 15 edge-of-field practices, the state’s share of the amount shall 16 not exceed 50 percent of the estimated cost of establishing the 17 practice as determined by the division or 50 percent of the 18 actual cost of establishing the practice, whichever is less. 19 (d) The demonstration projects shall be used to educate 20 other persons about the feasibility and value of establishing 21 similar water quality practices. The division shall promote 22 field day events for purposes of allowing interested persons to 23 establish water quality practices on their agricultural land. 24 (e) The division shall conduct water quality evaluations 25 within supported subwatersheds. Within a reasonable period 26 after accumulating information from such evaluations, the 27 division shall create an aggregated database of water quality 28 practices. Any information identifying a person holding a 29 legal interest in agricultural land or specific agricultural 30 land shall be a confidential record. 31 (4) The moneys appropriated in this lettered paragraph 32 shall be used to support education and outreach in a manner 33 that encourages persons who hold a legal interest in 34 agricultural land used for farming to implement water quality 35 -2- HF765.2269.S (1) 88 mb 2/ 19
practices, including the establishment of such practices in 1 watersheds generally, and not limited to subwatersheds or 2 high-priority watersheds. 3 (5) The moneys appropriated in this lettered paragraph 4 may be used to contract with persons to coordinate the 5 implementation of efforts provided in this paragraph. 6 (6) The moneys appropriated in this lettered paragraph 7 may be used by the department to support urban soil and water 8 conservation efforts, which may include but are not limited 9 to management practices related to bioretention, landscaping, 10 the use of permeable or pervious pavement, and soil quality 11 restoration. The moneys shall be allocated on a cost-share 12 basis as provided in chapter 161A . 13 (7) Notwithstanding any other provision of law to the 14 contrary, the department may use moneys appropriated in 15 this lettered paragraph to carry out the provisions of this 16 paragraph on a cost-share basis in combination with other 17 moneys available to the department from a state or federal 18 source. 19 (8) Not more than 10 percent of the moneys appropriated in 20 this lettered paragraph may be used for costs of administration 21 and implementation of the water quality initiative administered 22 by the soil conservation division. 23 b. However, if the project or projects for 20 which such appropriation was made are completed in an earlier 21 fiscal year, unencumbered or unobligated moneys shall revert at 22 the close of that same fiscal year. 23 DIVISION III 24 CHANGES TO PRIOR APPROPRIATIONS 25 Sec. 5. 2014 Iowa Acts, chapter 1136, section 2, as amended 26 by 2018 Iowa Acts, chapter 1162, section 8, is amended to read 27 as follows: 28 SEC. 2. REVERSION. 29 1. Sec. 7. 2016 Iowa Acts, chapter 1133, section 2, is amended 1 to read as follows: 2 SEC. 2. REVERSION. 3 1. For Except as provided in subsection 2, for purposes 4 of section 8.33 , unless specifically provided otherwise, 5 unencumbered or unobligated moneys made from an appropriation 6 in this division of this Act shall not revert but shall remain 7 available for expenditure for the purposes designated until the 8 close of the fiscal year that ends three years after the end of 9 the fiscal year for which the appropriation is made. However, 10 if the project or projects for which such appropriation was 11 made are completed in an earlier fiscal year, unencumbered 12 or unobligated moneys shall revert at the close of that same 13 fiscal year. 14 2. For purposes of section 8.33, unless specifically 15 provided otherwise, unencumbered or unobligated moneys 16 appropriated and allocated for the costs of major maintenance 17 of monuments without dedicated funds available for maintenance 18 and restoration, in section 1, subsection 1, in this division 19 of this 2016 Act, shall not revert but shall remain available 20 for the purpose designated until the close of the fiscal year 21 that begins July 1, 2023. 22 Sec. 8. EFFECTIVE DATE. This division of this Act, being 23 deemed of immediate importance, takes effect upon enactment. 24 DIVISION IV 25 DEPARTMENT OF ADMINISTRATIVE SERVICES 26 Sec. 9. Section 8A.321, Code 2019, is amended by adding the 27 following new subsection: 28 NEW SUBSECTION . 15. Prepare an annual report listing any 29 state building, as defined in section 8A.318, that is vacant 30 and submit the annual report to the legislative services agency 31 and the department of management on or before January 15 of 32 each year. 33 Sec. 10. 3. Moneys in the routine maintenance fund are appropriated 1 to the department for purposes of routine maintenance projects 2 for physical properties under the control of the department 3 state buildings and facilities, excluding buildings and 4 facilities under the control of the state board of regents, 5 state department of transportation, department of natural 6 resources, and department of public defense . For purposes of 7 this section , routine maintenance includes regular upkeep of 8 physical properties and recurring, preventive, and ongoing 9 maintenance necessary to delay or prevent the failure of 10 physical properties. 11 DIVISION V 12 MISCELLANEOUS PROVISIONS 13 Sec. 11. Section 8.57C, subsection 3, paragraph a, 14 subparagraph (2), Code 2019, is amended to read as follows: 15 (2) The fiscal year beginning July 1, 2019 2020 , and for 16 each subsequent fiscal year thereafter. 17 Sec. 12. Section 8.57C, subsection 3, Code 2019, is amended 18 by adding the following new paragraph: 19 NEW PARAGRAPH . h. There is appropriated from the rebuild 20 Iowa infrastructure fund for the fiscal year beginning July 1, 21 2019, and ending June 30, 2020, the sum of eighteen million 22 sixty-nine thousand nine hundred seventy-five dollars to the 23 technology reinvestment fund, notwithstanding section 8.57, 24 subsection 5, paragraph “c” . 25 Sec. 13. STATE HISTORICAL BUILDING TASK FORCE. 26 1. A state historical building task force is established 27 within the state fair authority. The state fair authority 28 shall provide administrative support for the task force. 29 2. The task force shall consist of the following members: 30 a. One member appointed by the Iowa state fair board. 31 b. One member appointed by the Iowa state fair foundation 32 established in section 173.22. 33 c. d. One member who is designated by the general assembly as 1 the facilities manager for facilities under the control of the 2 general assembly. 3 e. One member appointed by the director of the department of 4 cultural affairs. 5 f. One member appointed by the governor. 6 g. Four members of the general assembly serving as ex 7 officio, nonvoting members, with one representative to be 8 appointed by the speaker of the house of representatives, one 9 representative to be appointed by the minority leader of the 10 house of representatives, one senator to be appointed by the 11 majority leader of the senate, and one senator to be appointed 12 by the minority leader of the senate. 13 3. The task force shall consider the feasibility, costs, 14 and possible options relative to construction of a new state 15 historical building museum on the state fairgrounds, to include 16 options for relocating the collections stored in the current 17 state historical building and creating increased access to the 18 collections to Iowans. 19 4. The task force shall provide an interim report to 20 the general assembly by December 20, 2019, concerning the 21 activities of the task force and shall submit its final report, 22 including its findings and recommendations, to the general 23 assembly by January 1, 2021. 24 DIVISION VI 25 VACANT STATE BUILDINGS —— FUNDS 26 Sec. 14. NEW SECTION . 15.261 Vacant state buildings 27 demolition fund. 28 1. A vacant state buildings demolition fund is created in 29 the state treasury under the control of the authority. The 30 fund shall consist of all moneys appropriated to the fund. 31 2. Moneys in the vacant state buildings demolition fund are 32 appropriated to the authority for purposes of funding a grant 33 program for the demolition of vacant buildings owned by the 34 state which are no longer used for a state purpose. 35 -16- HF765.2269.S (1) 88 mb 16/ 19
3. Notwithstanding section 12C.7, subsection 2, interest 1 or earnings on moneys deposited in the vacant state buildings 2 demolition fund shall be credited to the vacant state buildings 3 demolition fund. Notwithstanding section 8.33, moneys credited 4 to the vacant state buildings demolition fund shall not revert 5 at the close of a fiscal year. 6 Sec. 15. NEW SECTION . 15.262 Vacant state buildings 7 rehabilitation fund. 8 1. A vacant state buildings rehabilitation fund is created 9 in the state treasury under the control of the authority. The 10 fund shall consist of all moneys appropriated to the fund. 11 2. Moneys in the vacant state buildings rehabilitation fund 12 are appropriated to the authority for purposes of funding a 13 loan program for the rehabilitation or redevelopment of vacant 14 buildings owned by the state which are no longer used for a 15 state purpose. 16 3. Notwithstanding section 12C.7, subsection 2, interest 17 or earnings on moneys deposited in the vacant state buildings 18 rehabilitation fund shall be credited to the vacant state 19 buildings rehabilitation fund. Notwithstanding section 8.33, 20 moneys credited to the vacant state buildings rehabilitation 21 fund shall not revert at the close of a fiscal year. 22 DIVISION VII 23 REGENTS CONSTRUCTION —— MATCH REQUIREMENTS 24 Sec. 16. NEW SECTION . 262.67 State appropriations —— match 25 requirements. 26 1. The board shall, as a condition of receiving an 27 appropriation from the rebuild Iowa infrastructure fund 28 created in section 8.57 for the construction of buildings and 29 facilities at an institution as defined in section 262.55, 30 require the applicable institution to provide a match from both 31 private and public sources excluding funding from the state as 32 provided in this section. 33 2. a. For construction of buildings and facilities at 34 the state university of Iowa and the Iowa state university 35 -17- HF765.2269.S (1) 88 mb 17/ 19
of science and technology, a match of at least two dollars 1 for each three dollars appropriated from the rebuild Iowa 2 infrastructure fund created in section 8.57. 3 b. For construction of buildings and facilities at the 4 university of northern Iowa, a match of at least one dollar 5 for each four dollars appropriated from the rebuild Iowa 6 infrastructure fund created in section 8.57. 7 3. This section does not apply to an appropriation from 8 the rebuild Iowa infrastructure fund created in section 8.57 9 for debt service payments on academic revenue bonds issued in 10 accordance with chapter 262A for capital projects at board of 11 regents institutions. 12 Sec. 17. APPLICABILITY. This division of this Act applies 13 to new construction projects commenced on or after July 1, 14 2020. 15 DIVISION VIII 16 ON-STREAM IMPOUNDMENT RESTORATION 17 Sec. 18. NEW SECTION . 456A.33C On-stream impoundment 18 restoration fund. 19 1. For purposes of this section, unless the context 20 otherwise requires, “eligible water body” means a body of water 21 that meet all of the following criteria: 22 a. Is owned by the state of Iowa, a county, a municipal 23 government, or a public entity organized under chapter 357E. 24 b. Is a multi-use system capable of supporting diverse 25 wildlife, fish, and recreational opportunities. 26 c. Has a surface water area of at least ten acres. 27 d. Has a watershed-to-body of water ratio of not less than 28 two hundred to one and not more than one thousand to one. 29 e. Is a public body of water with public access. 30 f. Has diverse water depths and is capable of supporting 31 aquatic vegetation. 32 g. Is not used solely as a water supply reservoir. 33 2. An on-stream impoundment restoration fund is created in 34 the state treasury under the control of the department. The 35 -18- HF765.2269.S (1) 88 mb 18/ 19
fund shall consist of all moneys appropriated to the fund. 1 3. a. Moneys in the on-stream impoundment restoration fund 2 are appropriated to the department subject to the requirements 3 of this section for purposes of funding projects for the 4 maintenance, restoration, and sustainability of eligible water 5 bodies and their related watersheds. 6 b. The department shall fund projects from the on-stream 7 impoundment restoration fund for eligible water bodies that are 8 designed to achieve the following goals: 9 (1) Ensure a cost-effective, positive return on investment 10 for the citizens of Iowa. 11 (2) Ensure local community commitment to watershed 12 protection. 13 (3) Ensure significant improvement in water clarity, 14 safety, and quality. 15 (4) Provide for sustainable, healthy, and functioning 16 bodies of water. 17 (5) Contribute to the department’s fish and wildlife 18 conservation plans. 19 c. The process and criteria the department shall utilize 20 to fund projects under this section shall favor proposals 21 which include nonstate matching funds of at least one dollar 22 for every dollar of state funding, and funding for watershed 23 improvement practices and participation of corresponding 24 watershed management authority. 25 4. Notwithstanding section 12C.7, subsection 2, interest 26 or earnings on moneys deposited in the on-stream impoundment 27 restoration fund shall be credited to the on-stream impoundment 28 restoration fund. Notwithstanding section 8.33, moneys 29 credited to the on-stream impoundment restoration fund that 30 remain unobligated and unencumbered at the close of a fiscal 31 year shall not revert. > 32 2.
