used to provide grants to care providers providing services to 1 crime victims of domestic abuse or to crime victims of rape and 2 sexual assault. 3 The balance of the victim compensation fund established 4 in section 915.94 may be used to provide salary and support 5 of not more than 24.00 full-time equivalent positions and to 6 provide maintenance for the victim compensation functions 7 of the department of justice. In addition to the full-time 8 equivalent positions authorized pursuant to this paragraph, 9 5.00 full-time equivalent positions are authorized and shall 10 be used by the department of justice to employ one accountant 11 and four program planners. The department of justice may 12 employ the additional 5.00 full-time equivalent positions 13 authorized pursuant to this paragraph that are in excess of the 14 number of full-time equivalent positions authorized only if 15 the department of justice receives sufficient federal moneys 16 to maintain employment for the additional full-time equivalent 17 positions during the current fiscal year. The department 18 of justice shall only employ the additional 5.00 full-time 19 equivalent positions in succeeding fiscal years if sufficient 20 federal moneys are received during each of those succeeding 21 fiscal years. 22 The department of justice shall transfer at least $150,000 23 from the victim compensation fund established in section 915.94 24 to the victim assistance grant program. 25 Notwithstanding section 8.33, moneys appropriated in this 26 paragraph “b” that remain unencumbered or unobligated at the 27 close of the fiscal year shall not revert but shall remain 28 available for expenditure for the purposes designated until the 29 close of the succeeding fiscal year. 30 c. to section 8.23, shall include a report of funding from sources 1 other than amounts appropriated directly from the general fund 2 of the state to the department of justice or to the office of 3 consumer advocate. These funding sources shall include but 4 are not limited to reimbursements from other state agencies, 5 commissions, boards, or similar entities, and reimbursements 6 from special funds or internal accounts within the department 7 of justice. The department of justice shall also report actual 8 reimbursements for the fiscal year commencing July 1, 2018, 9 and actual and expected reimbursements for the fiscal year 10 commencing July 1, 2019. 11 b. The department of justice shall include the report 12 required under paragraph “a”, as well as information regarding 13 any revisions occurring as a result of reimbursements actually 14 received or expected at a later date, in a report to the 15 co-chairpersons and ranking members of the joint appropriations 16 subcommittee on the justice system and the legislative services 17 agency. The department of justice shall submit the report on 18 or before January 15, 2020. 19 3. a. The department of justice shall fully reimburse 20 the costs and necessary related expenses incurred by the Iowa 21 law enforcement academy to continue to employ one additional 22 instructor position who shall provide training for human 23 trafficking-related issues throughout the state. 24 b. The department of justice shall obtain the moneys 25 necessary to reimburse the Iowa law enforcement academy to 26 employ such an instructor from unrestricted moneys from either 27 the victim compensation fund established in section 915.94, the 28 human trafficking victim fund established in section 915.95, or 29 the human trafficking enforcement fund established in 2015 Iowa 30 Acts, chapter 138, section 141. 31 Sec. 2. It is the intent of the general assembly that each 9 lease negotiated by the department of corrections with a 10 private corporation for the purpose of providing private 11 industry employment of inmates in a correctional institution 12 shall prohibit the private corporation from utilizing inmate 13 labor for partisan political purposes for any person seeking 14 election to public office in this state and that a violation 15 of this requirement shall result in a termination of the lease 16 agreement. 17 b. It is the intent of the general assembly that as a 18 condition of receiving the appropriation provided in this 19 subsection the department of corrections shall not enter into 20 a lease or contractual agreement pursuant to section 904.809 21 with a private corporation for the use of building space for 22 the purpose of providing inmate employment without providing 23 that the terms of the lease or contract establish safeguards to 24 restrict, to the greatest extent feasible, access by inmates 25 working for the private corporation to personal identifying 26 information of citizens. 27 2. 3. Each judicial district department of correctional 1 services shall provide alternatives to prison consistent with 2 chapter 901B. The alternatives to prison shall ensure public 3 safety while providing maximum rehabilitation to the offender. 4 A judicial district department of correctional services may 5 also establish a day program. 6 4. The governor’s office of drug control policy shall 7 consider federal grants made to the department of corrections 8 for the benefit of each of the eight judicial district 9 departments of correctional services as local government 10 grants, as defined pursuant to federal regulations. 11 5. The department of corrections shall continue to contract 12 with a judicial district department of correctional services to 13 provide for the rental of electronic monitoring equipment which 14 shall be available statewide. 15 6. The public safety assessment shall not be utilized 16 in pretrial hearings when determining whether to detain or 17 release a defendant before trial, and the use of the public 18 safety assessment pilot program shall be terminated as of the 19 effective date of this subsection, until such time the use of 20 the public safety assessment has been specifically authorized 21 by the general assembly. 22 Sec. 6. DEPARTMENT OF CORRECTIONS —— REALLOCATION OF 23 APPROPRIATIONS. Notwithstanding section 8.39, within the 24 moneys appropriated in this division of this Act to the 25 department of corrections, the department may reallocate the 26 moneys appropriated and allocated as necessary to best fulfill 27 the needs of the correctional institutions, administration 28 of the department, and the judicial district departments of 29 correctional services. However, in addition to complying with 30 the requirements of sections 904.116 and 905.8 and providing 31 notice to the legislative services agency, the department 32 of corrections shall also provide notice to the department 33 of management, prior to the effective date of the revision 34 or reallocation of an appropriation made pursuant to this 35 -9- SF615.2046 (1) 88 asf/tm 9/ 26
section. The department of corrections shall not reallocate an 1 appropriation or allocation for the purpose of eliminating any 2 program. 3 Sec. 7. INTENT —— REPORTS. 4 1. The department of corrections in cooperation with 5 townships, the Iowa cemetery associations, and other nonprofit 6 or governmental entities may use inmate labor during the 7 fiscal year beginning July 1, 2019, to restore or preserve 8 rural cemeteries and historical landmarks. The department in 9 cooperation with the counties may also use inmate labor to 10 clean up roads, major water sources, and other water sources 11 around the state. 12 2. On a quarterly basis the department shall provide a 13 status report regarding private-sector employment to the 14 legislative services agency beginning on July 1, 2019. The 15 report shall include the number of offenders employed in the 16 private sector, the combined number of hours worked by the 17 offenders, the total amount of allowances, and the distribution 18 of allowances pursuant to section 904.702, including any moneys 19 deposited in the general fund of the state. 20 Sec. 8. ELECTRONIC MONITORING REPORT. The department of 21 corrections shall submit a report on electronic monitoring to 22 the general assembly, to the co-chairpersons and the ranking 23 members of the joint appropriations subcommittee on the justice 24 system, and to the legislative services agency by January 25 15, 2020. The report shall specifically address the number 26 of persons being electronically monitored and break down the 27 number of persons being electronically monitored by offense 28 committed. The report shall also include a comparison of any 29 data from the prior fiscal year with the current year. 30 Sec. 9. STATE AGENCY PURCHASES FROM PRISON INDUSTRIES. 31 1. As used in this section, unless the context otherwise 32 requires, “state agency” means the government of the state 33 of Iowa, including but not limited to all executive branch 34 departments, agencies, boards, bureaus, and commissions, the 35 -10- SF615.2046 (1) 88 asf/tm 10/ 26
judicial branch, the general assembly and all legislative 1 agencies, institutions within the purview of the state board of 2 regents, and any corporation whose primary function is to act 3 as an instrumentality of the state. 4 2. State agencies are encouraged to purchase products from 5 Iowa state industries, as defined in section 904.802, when 6 purchases are required and the products are available from 7 Iowa state industries. State agencies shall obtain bids from 8 Iowa state industries for purchases of office furniture during 9 the fiscal year beginning July 1, 2019, exceeding $5,000 or 10 in accordance with applicable administrative rules related to 11 purchases for the agency. 12 Sec. 10. IOWA LAW ENFORCEMENT ACADEMY. 13 1. There is appropriated from the general fund of the 14 state to the Iowa law enforcement academy for the fiscal year 15 beginning July 1, 2019, and ending June 30, 2020, the following 16 amount, or so much thereof as is necessary, to be used for the 17 purposes designated: 18 a. of state patrol, prior to turning over the automobiles to 1 the department of administrative services to be disposed 2 of by public auction, and the Iowa law enforcement academy 3 may exchange any automobile owned by the academy for each 4 automobile selected if the selected automobile is used in 5 training law enforcement officers at the academy. However, any 6 automobile exchanged by the academy shall be substituted for 7 the selected vehicle of the department of public safety and 8 sold by public auction with the receipts being deposited in the 9 depreciation fund to the credit of the department of public 10 safety, division of state patrol. 11 3. The Iowa law enforcement academy shall provide training 12 for domestic abuse and human trafficking-related issues 13 throughout the state. The training shall be offered at no 14 cost to the attendees and the training shall not replace any 15 existing domestic abuse or human trafficking training offered 16 by the academy. 17 Sec. 11. STATE PUBLIC DEFENDER. Section 13.2, subsection 1, paragraph b, Code 2019, 27 is amended to read as follows: 28 b. (1) Prosecute and defend in any other Iowa court or 29 tribunal, all actions and proceedings, civil or criminal, in 30 which the state may be a party or interested, when, in the 31 attorney general’s judgment, the interest of the state requires 32 such action, or when requested to do so by the governor, 33 executive council, or general assembly. 34 (2) (a) Prosecute in any other court or tribunal other than 35 -20- SF615.2046 (1) 88 asf/tm 20/ 26

NEW SECTION . 13.12 Report of money awards. 11 The attorney general shall report to the legislative 12 services agency and the department of management all money 13 settlement awards and court money awards which were awarded to 14 the state of Iowa. The attorney general shall report which 15 funds are designated to receive the moneys and under what legal 16 authority the designation is being made. 17 Sec. 26. 2014 Iowa Acts, chapter 1138, section 21, as 18 amended by 2016 Iowa Acts, chapter 1137, section 18, and 2017 19 Iowa Acts, chapter 167, section 24, is amended to read as 20 follows: 21 SEC. 21. CONSUMER EDUCATION AND LITIGATION 22 FUND. Notwithstanding section 714.16C , for each fiscal 23 year of the period beginning July 1, 2014, and ending June 24 30, 2019 2021 , the annual appropriations in section 714.16C , 25 are increased from $1,125,000 to $1,875,000, and $75,000 to 26 $125,000 respectively. 27 DIVISION IV 28 FIRE SERVICE TRAINING REVOLVING FUND 29 Sec. 27. Section 100B.4, Code 2019, is amended to read as 30 follows: 31 100B.4 Fees —— retention —— use —— fund . 32 1. Fees assessed pursuant to this chapter shall be retained 33 by the division of state fire marshal and such repayments 34 received shall be used exclusively to offset the cost of 35 -21- SF615.2046 (1) 88 asf/tm 21/ 26
fire service training. Fees charged by regional emergency 1 response training centers for fire service training programs as 2 described in section 100B.6 shall not be greater than the fee 3 schedule established by rule by the state fire marshal. 4 2. Notwithstanding section 8.33 , repayment receipts 5 collected by the division of state fire marshal for the fire 6 service training bureau that remain unencumbered or unobligated 7 at the close of the fiscal year shall not revert but shall 8 remain available for expenditure for the purposes designated 9 until the close of the succeeding fiscal year. 10 3. A fire service training revolving fund is created in the 11 state treasury under the control of the department of public 12 safety. The fund shall consist of fees assessed pursuant to 13 this section, and deposited into the fire service training 14 revolving fund. All moneys in the fund are appropriated to 15 the department of public safety for purposes of fire service 16 training and shall be under the control of the state fire 17 marshal. Notwithstanding section 8.33, moneys in the fund 18 that remain unencumbered or unobligated at the close of a 19 fiscal year shall not revert but shall remain available for 20 expenditures for the purposes designated until the close of 21 the succeeding fiscal year. Notwithstanding section 12C.7, 22 subsection 2, interest or earnings on moneys in the fund shall 23 be credited to the fund. 24 Sec. 28. EFFECTIVE DATE. This division of this Act, being 25 deemed of immediate importance, takes effect upon enactment. 26 Sec. 29. RETROACTIVE APPLICABILITY. This division of this 27 Act applies retroactively to July 1, 2018. 28 DIVISION V 29 DEPARTMENT OF CORRECTIONS 30 Sec. 30. DEPARTMENT OF CORRECTIONS. Notwithstanding 31 sections 8.33 and 8.39, the department of corrections may use 32 any general fund resources appropriated to the department 33 for the fiscal year beginning July 1, 2018, and ending June 34 30, 2019, for the resolution of the settlement agreement 35 -22- SF615.2046 (1) 88 asf/tm 22/ 26
with the division of labor services to the amended citation 1 P1582-1281728 dated October 18, 2018; requiring the department 2 to remedy citation 1(a) by providing adequate means of 3 communication for employees to summon assistance during violent 4 attacks, which must be abated by March 1, 2019. 5 Sec. 31. EFFECTIVE DATE. This division of this Act, being 6 deemed of immediate importance, takes effect upon enactment. 7 DIVISION VI 8 INDIGENT DEFENSE 9 Sec. 32. Section 815.7, subsection 4, Code 2019, is amended 10 to read as follows: 11 4. For appointments made on or after July 1, 2007, through 12 June 30, 2019, the reasonable compensation shall be calculated 13 on the basis of seventy dollars per hour for class “A” 14 felonies, sixty-five dollars per hour for class “B” felonies, 15 and sixty dollars per hour for all other cases. 16 Sec. 33. Section 815.7, Code 2019, is amended by adding the 17 following new subsection: 18 NEW SUBSECTION . 4A. For appointments made on or after July 19 1, 2019, the reasonable compensation shall be calculated on the 20 basis of seventy-three dollars and twenty-five cents per hour 21 for class “A” felonies, sixty-eight dollars and twenty-five 22 cents per hour for class “B” felonies, and sixty-three dollars 23 and twenty-five cents per hour for all other cases. 24 Sec. 34. 2016 Iowa Acts, chapter 1137, section 21, 25 subsection 1, is amended to read as follows: 26 1. Notwithstanding any other provision of the law to the 27 contrary, for each fiscal year for the period beginning July 1, 28 2016, and ending June 30, 2019 2022 , the state public defender 29 may establish a pilot project allowing an indigent person to 30 choose an eligible attorney to represent the person in the 31 person’s case that requires such representation. The state 32 public defender shall have sole discretion to establish the 33 pilot project in no more than four counties throughout the 34 state. The state public defender may coordinate with other 35 -23- SF615.2046 (1) 88 asf/tm 23/ 26
agencies and organizations in order to seek grant funding and 1 to measure the results of the pilot project. 2 Sec. 35. EFFECTIVE DATE. The following, being deemed of 3 immediate importance, takes effect upon enactment: 4 The section of this division of this Act amending 2016 Iowa 5 Acts, Chapter 1137, section 21, subsection 1. 6 DIVISION VII 7 PUBLIC SAFETY SURVIVOR BENEFITS FUND 8 Sec. 36. NEW SECTION . 80.47 Public safety survivor benefits 9 fund. 10 1. A public safety survivor benefits fund is established in 11 the state treasury under the control of the department. The 12 fund shall consist of moneys transferred to the fund pursuant 13 to section 99G.39 and any other moneys appropriated to or 14 deposited in the fund. Moneys in the fund are appropriated to 15 the department for the purposes set forth in subsection 2. 16 2. a. Of the moneys credited to the fund in a fiscal year, 17 the department shall distribute fifty percent in the form of 18 grants to nonprofit organizations that provide resources to 19 assist surviving families of eligible peace officers killed in 20 the line of duty in paying costs associated with accident or 21 health care coverage pursuant to section 509A.13C. In awarding 22 such grants, the department shall give first consideration 23 to concerns of police survivors, inc., and similar nonprofit 24 organizations providing such resources. 25 b. Of the moneys credited to the fund in a fiscal year, 26 the department shall distribute fifty percent in the form of 27 grants to nonprofit organizations that provide resources to 28 assist surviving families of eligible fire fighters killed in 29 the line of duty in paying costs associated with accident or 30 health care coverage pursuant to section 509A.13C. In awarding 31 such grants, the department shall give first consideration to 32 Iowa professional fire fighters, inc., and similar nonprofit 33 organizations providing such resources. 34 3. Notwithstanding section 8.33, moneys in the fund 35 -24- SF615.2046 (1) 88 asf/tm 24/ 26
that remain unencumbered or unobligated at the close of a 1 fiscal year shall not revert but shall remain available for 2 expenditure for the purposes designated. Notwithstanding 3 section 12C.7, subsection 2, interest or earnings on moneys in 4 the fund shall be credited to the fund. 5 Sec. 37. Section 99G.39, Code 2019, is amended by adding the 6 following new subsection: 7 NEW SUBSECTION . 3A. One hundred thousand dollars in lottery 8 revenues shall be transferred each fiscal year to the public 9 safety survivor benefits fund established pursuant to section 10 80.47 prior to deposit of the lottery revenues in the general 11 fund pursuant to section 99G.40. 12 Sec. 38. Section 99G.39, subsection 4, paragraph a, Code 13 2019, is amended to read as follows: 14 a. Notwithstanding subsection 1 , if gaming revenues under 15 sections 99D.17 and 99F.11 are insufficient in a fiscal year to 16 meet the total amount of such revenues directed to be deposited 17 in the vision Iowa fund during the fiscal year pursuant to 18 section 8.57, subsection 5 , paragraph “e” , the difference shall 19 be paid from lottery revenues prior to deposit of the lottery 20 revenues in the general fund , and transfer of lottery revenues 21 to the veterans trust fund as provided in subsection 3 , and 22 the transfer of lottery revenues to the public safety survivor 23 benefits fund as provided in subsection 3A . If lottery 24 revenues are insufficient during the fiscal year to pay the 25 difference, the remaining difference shall be paid from lottery 26 revenues prior to deposit of lottery revenues in the general 27 fund , and the transfer of lottery revenues to the veterans 28 trust fund as provided in subsection 3 , and the transfer of 29 lottery revenues to the public safety survivor benefits fund as 30 provided in subsection 3A in subsequent fiscal years as such 31 revenues become available. > 32 -25- SF615.2046 (1) 88 asf/tm 25/ 26
