Section 123.3, subsections 7 and 48, Code 2019, 3 are amended to read as follows: 4 7. “Beer” means any liquid , excluding wine, capable of 5 being used for beverage purposes made by the fermentation of 6 an infusion in potable water of barley, malt, and hops, with 7 or without unmalted grains or decorticated and degerminated 8 grains or made by the fermentation of or by distillation of 9 the fermented products of fruit, fruit extracts, or other 10 agricultural products, containing more than one-half of one 11 percent of alcohol by volume but not more than five percent of 12 alcohol by weight or six and twenty-five hundredths percent of 13 alcohol by volume but not including mixed drinks or cocktails 14 mixed on the premises. 15 48. “Wine” means any beverage containing more than five 16 one and one-half percent of alcohol by weight but not more 17 than seventeen percent of alcohol by weight or twenty-one and 18 twenty-five hundredths percent of alcohol by volume obtained 19 by the fermentation of the natural sugar contents of fruits 20 or other agricultural products but excluding any product 21 containing alcohol derived from malt or by the distillation 22 process from grain, cereal, molasses, or cactus. > 23 2.
