(1) In the context of water pollution control 4 facilities, the acquisition, construction, reconstruction, 5 extension, equipping, improvement, or rehabilitation of any 6 works and facilities useful for the collection, treatment, and 7 disposal of sewage and industrial waste in a sanitary manner 8 including treatment works as defined in section 212 of the 9 Clean Water Act, or the implementation and development of 10 management programs established under sections 319 and 320 of 11 the Clean Water Act, including construction and undertaking of 12 nonpoint source water pollution control projects and related 13 development activities authorized under those sections. 14 (2) On and after July 1, 2019, nonpoint source water 15 pollution control projects for purposes of subparagraph (1), 16 shall not include the acquisition of real property by a private 17 entity for future donation or sale to a political subdivision, 18 the department, or the federal government except as included in 19 subparagraph (3). 20 (3) Subparagraph (2) does not apply to the acquisition of 21 land by a private entity intended for such future donation when 22 the private entity acquires any of the following: 23 (a) Only that portion of land on which an edge-of-field 24 practice consistent with the Iowa nutrient reduction strategy 25 is installed to provide water quality benefits beyond the 26 geographic footprint of the practice. 27 (b) Any necessary setbacks to a portion of land included in 28 subparagraph division (a) as authorized by the department. > 29 2.
