a.
(1)
A
rate-regulated
public
utility
shall
not
install
a
7
digital
meter
or
smart
meter
at
a
customer’s
residence
or
place
8
of
business
on
or
after
July
1,
2019,
without
first
providing
9
the
customer
with
educational
information
regarding
the
10
full
scope
of
the
digital
meter
or
smart
meter’s
functioning
11
and
effects,
including
but
not
limited
to
health
and
safety
12
warnings,
and
the
opportunity
to
consent
to
the
installation
13
or
refuse
such
consent
by
electing
to
keep
or
receive
an
14
electromechanical
analog
meter
instead
of
the
digital
meter
or
15
smart
meter.

(2)
A
rate-regulated
public
utility
shall
offer
to
replace
17
a
digital
meter
or
smart
meter
with
an
electromechanical
analog
18
meter
free
of
charge
and
at
any
time
upon
a
customer’s
request.
19
(3)
A
rate-regulated
public
utility
shall
not
offer
to
20
provide
or
provide
discounted
rates
to
customers
in
exchange
21
for
obtaining
the
customer’s
consent
to
install
a
digital
meter
22
or
smart
meter,
and
shall
not
charge
a
fee,
assessment,
or
23
higher
rate
to
any
customer
choosing
not
to
consent
to
the
24
installation
of
a
digital
meter
or
smart
meter,
or
requesting
25
the
replacement
of
a
digital
meter
or
smart
meter
with
an
26
electromechanical
analog
meter.

(4)
The
board
shall
adopt
rules
to
implement
this
28
subsection.

b.
For
purposes
of
this
subsection:

(1)
“Digital
meter”
means
a
public
utility
meter
which
uses
31
electronic
components
and
produces
conducted
emissions.

(2)
“Electromechanical
analog
meter”
means
a
public
33
utility
meter
which
is
purely
electric
and
mechanical,
uses
34
no
electronic
components,
has
no
radio
frequency
or
conducted

and
is
not
upgraded
to
function
as
a
digital
meter

or
smart
meter.

“Smart
meter”
means
an
advanced
metering
infrastructure

device
which
uses
radio

other
wireless
means
for
two-way

communication
between
the
device
and
a
public
utility,
an
5
advanced
meter
reading
device
using
radio
or
other
wireless

means
for
one-way
communication
between
the
device
and
a
public
7
utility,
or
any
public
utility
meter
that
emits
wireless
8
radiofrequency
electromagnetic
radiation
or
requires
a
direct
9
current
to
operate.
