Section 513B.2, subsections 10 and 18, Code 2018, 3 are amended to read as follows: 4 10. “Eligible employee” means an employee who works on a 5 full-time basis and has a normal workweek of thirty or more 6 hours. The term includes a sole proprietor, a partner of 7 a partnership, and an independent contractor, if the sole 8 proprietor, partner, or independent contractor is included 9 as an employee under health insurance coverage of a small 10 employer, but does not include an employee who works on a 11 part-time, temporary, or substitute basis. An internal revenue 12 service form W-2 wage and tax statement shall not be required 13 to qualify as an eligible employee under this subsection. 14 18. “Small employer” means a person , other than a 15 limited liability company, a partner of a partnership, an S 16 corporation, a C corporation, or an independent contractor, 17 actively engaged in business who, on at least fifty percent 18 of the employer’s working days during the preceding year, 19 employed at least one and not more than fifty full-time 20 equivalent eligible employees. A limited liability company, a 21 partner of a partnership, an S corporation, a C corporation, 22 or an independent contractor shall not be required to employ 23 an eligible employee to qualify as a small employer under 24 this subsection. “Small employer” includes a self-employed 25 individual. In determining the number of eligible employees, 26 companies which are affiliated companies or which are eligible 27 to file a combined tax return for purposes of state taxation 28 are considered one employer. > 29 2.
