each fiscal year thereafter through the fiscal year beginning 1 July 1, 2017 , of the wagering tax receipts received pursuant to 2 sections 99D.17 and 99F.11 , the next sixty-six million dollars 3 shall be deposited in the Iowa skilled worker and job creation 4 fund created in section 8.75 . 5 (ii) For the fiscal year beginning July 1, 2018, and for 6 each fiscal year thereafter, of the wagering tax receipts 7 received pursuant to sections 99D.17 and 99F.11, the next 8 sixty-three million seven hundred fifty thousand dollars shall 9 be deposited in the Iowa skilled worker and job creation fund 10 created in section 8.75. 11 Sec. ___. Section 8.57, subsection 5, paragraph f, 12 subparagraph (1), Code 2018, is amended by adding the following 13 new subparagraph division: 14 NEW SUBPARAGRAPH DIVISION . (0d) For the fiscal year 15 beginning July 1, 2018, and for each fiscal year thereafter, of 16 the wagering tax receipts received pursuant to sections 99D.17 17 and 99F.11, the next two million two hundred fifty thousand 18 dollars shall be deposited in the general fund of the state. 19 Sec. ___. Section 8.57, subsection 5, paragraph f, 20 subparagraph (1), subparagraph division (d), Code 2018, is 21 amended to read as follows: 22 (d) For the fiscal year beginning July 1, 2013, 2018, and 23 for each fiscal year thereafter, the total moneys in excess of 24 the moneys deposited under this paragraph “f” in the revenue 25 bonds debt service fund, the revenue bonds federal subsidy 26 holdback fund, the vision Iowa fund, and the Iowa skilled 27 worker and job creation fund , and the general fund of the state 28 shall be deposited in the rebuild Iowa infrastructure fund and 29 shall be used as provided in this section , notwithstanding 30 section 8.60 . 31 Sec. ___. Section 96.5, Code 2018, is amended by adding the 32 following new subsection: 33 NEW SUBSECTION . 13. Overpayment resulting in 34 disqualification. has received benefits by reason of misrepresentation pursuant 1 to section 96.16, such individual shall be disqualified for 2 benefits until the balance of the benefits received by the 3 individual due to misrepresentation, including all penalties, 4 interest, and lien fees, is paid in full. 5 Sec. ___. NEW SECTION . 507E.2A Definition of insurer —— 6 workers’ compensation. 7 As used in this chapter, unless the context otherwise 8 requires: 9 1. “Insurance” means any and all contracts, arrangements, 10 and agreements by or through which one party, for compensation, 11 assumes risks of another party and promises to pay the second 12 party or the second party’s nominee a certain or ascertainable 13 sum of money on the occurrence of a specified contingency. 14 “Insurance” includes any and all contracts, arrangements, or 15 agreements contemplated by, falling within, and coming under 16 section 87.11. Without limiting the foregoing, “insurance” 17 includes any contract of insurance, indemnity, subscription, 18 membership, suretyship, or annuity that has been issued, is 19 proposed for issuance, or is intended for issuance by any 20 person or entity. 21 2. “Insurer” includes an insurer that issues a policy of 22 workers’ compensation, a self-insured business for purposes of 23 workers’ compensation liability, or a group or self-insured 24 plan as described in section 87.4. > 25 ______________________________ MARK LOFGREN -3- HF2493.5542 (5) 87 ko/tm 3/ 3
