Section 802.2A, Code 2018, is amended to read as 3 follows: 4 802.2A Incest —— sexual exploitation by a counselor, 5 therapist, or school employee. 6 1. An information or indictment for incest under section 7 726.2 committed on or with a person who is under the age of 8 eighteen shall be found within ten years after the person upon 9 whom the offense is committed attains eighteen years of age at 10 any time after its commission . An information or indictment 11 for any other incest shall be found within ten years after its 12 commission. 13 2. An indictment or information for sexual exploitation 14 by a counselor, therapist, or school employee under section 15 709.15 committed on or with a person who is under the age of 16 eighteen shall be found within ten years after the person upon 17 whom the offense is committed attains eighteen years of age at 18 any time after its commission . An information or indictment 19 for any other sexual exploitation shall be found within ten 20 years of the date the victim was last treated by the counselor 21 or therapist, or within ten years of the date the victim was 22 enrolled in or attended the school. 23 Sec. ___. Section 802.2B, unnumbered paragraph 1, Code 24 2018, is amended to read as follows: 25 An information or indictment for the following offenses 26 committed on or with a person who is under the age of eighteen 27 years shall be found within ten years after the person upon 28 whom the offense is committed attains eighteen years of age, 29 or if the person against whom the information or indictment 30 is sought is identified through the use of a DNA profile, an 31 information or indictment shall be found within three years 32 from the date the person is identified by the person’s DNA 33 profile, whichever is later at any time after its commission : > 34 2.
