REMOVAL OF AUTOMATED OR REMOTE SYSTEMS FOR 3 TRAFFIC LAW ENFORCEMENT —— VALIDITY OF PRIOR NOTICES AND 4 CITATIONS —— CONTRACTS AND AGREEMENTS VOID. 5 1. Prior to July 1, 2018, a local authority using an 6 automated or remote system for traffic law enforcement shall 7 discontinue using the system and remove the system equipment. 8 2. Effective July 1, 2018, all local ordinances authorizing 9 the use of automated or remote systems for traffic law 10 enforcement are void. However, any citation issued or mailed 11 pursuant to such an ordinance prior to July 1, 2018, shall 12 not be invalidated by the enactment of this Act and shall be 13 processed according to the provisions of law under which the 14 citation was authorized. 15 3. Effective July 1, 2018, all contracts and agreements 16 between local authorities and private entities related to the 17 installation, operation, maintenance, or use of automated or 18 remote systems for traffic law enforcement are null and void. 19 However, any obligation required to be performed or any payment 20 due pursuant to such a contract or agreement prior to July 1, 21 2018, shall be performed or paid pursuant to the terms of the 22 contract or agreement, unless otherwise agreed upon by the 23 parties to the contract or agreement. Any obligation required 24 to be performed or any payment due pursuant to such a contract 25 or agreement related to valid citations processed on or after 26 July 1, 2018, pursuant to subsection 2 shall be performed 27 or paid pursuant to the terms of the contract or agreement, 28 unless otherwise agreed upon by the parties to the contract or 29 agreement. > 30 2.
