LEGISLATIVE INTERIM —— DEPARTMENTAL STAKEHOLDER 8 WORKGROUP —— FACILITY FOR ELDERLY INDIVIDUALS WITH AGGRESSIVE, 9 COMBATIVE, OR PSYCHIATRIC BEHAVIORS. 10 1. The legislative council is requested to establish an 11 interim study committee for the 2017 interim to examine options 12 for designating or establishing a facility to provide care for 13 elderly individuals who are sexually aggressive, combative, or 14 have unmet geropsychiatric needs. The interim study committee 15 shall meet to receive and review the report of the stakeholder 16 workgroup established pursuant to subsection 2, and the interim 17 study committee shall submit its report, including findings and 18 recommendations, to the governor and the general assembly by 19 December 15, 2017. 20 2. a. The department of inspections and appeals, in 21 cooperation with the department of human services, shall 22 establish and facilitate a stakeholder workgroup to examine 23 options for designating or establishing a facility to provide 24 care for elderly individuals in this state who are sexually 25 aggressive, combative, or have unmet geropsychiatric needs. 26 b. The membership of the stakeholder workgroup shall 27 include but is not limited to representatives of all of the 28 following: 29 (1) The departments of inspections and appeals, human 30 services, corrections, and public health, the department on 31 aging, the state public defender, the office of ombudsman, the 32 office of long-term care ombudsman, and the judicial branch. 33 (2) Consumers of services provided by long-term care 34 facilities and family members of consumers. 35 -1- HF653.2608 (2) 87 pf/rn 1/ 2 #1.
(3) Leadingage Iowa, the Iowa health care association, and 1 the Iowa association of community providers. 2 (4) Direct care workers providing care in long-term care 3 facilities. 4 (5) Iowa legal aid. 5 (6) AARP Iowa chapter. 6 (7) The Iowa civil liberties union. 7 (8) Other stakeholders with interest or expertise in the 8 subject as deemed appropriate by the department of inspections 9 and appeals and the department of human services. 10 c. The stakeholder workgroup shall consider options for 11 designating or establishing a facility as specified in this 12 subsection and shall consider whether a long-term care facility 13 should have the ability to refuse admission to or discharge 14 from a facility, individuals who are sexually aggressive, 15 combative, or have unmet geropsychiatric needs. The workgroup 16 shall identify the characteristics of individuals who are 17 sexually aggressive, combative, or have unmet geropsychiatric 18 needs; review workforce needs, recruitment, training, and 19 compensation necessary to maintain such a facility; review 20 requirements to receive Medicaid reimbursement for such 21 a facility; provide cost projections associated with any 22 recommendations made; and review any other relevant issues. 23 d. The stakeholder workgroup shall provide a report to 24 the interim study committee created pursuant to subsection 25 1 no later than October 31, 2017, detailing its findings 26 and recommendations for further review by the interim study 27 committee. > 28 2.
