Section 299.4, subsection 1, Code 2017, is 4 amended to read as follows: 5 1. The parent, guardian, or legal custodian of a child 6 who is of compulsory attendance age, who places the child 7 under competent private instruction under section 299A.2 , or 8 private instruction under section 299A.3, not in an accredited 9 school or a home school assistance program operated by a school 10 district or accredited nonpublic school, shall furnish to the 11 school district of residence a report in duplicate on forms 12 provided in the form and manner prescribed by the public school 13 district, to the district by September 1 of the school year in 14 which the child will be under competent private instruction 15 or private instruction . The secretary shall retain and file 16 one copy and forward the other copy to the district’s area 17 education agency. The report shall state the name and age 18 of the child, the period of time during which the child has 19 been or will be under competent private instruction or private 20 instruction for the year , an outline of the course of study, 21 texts used, and the name and address of the instructor . The 22 parent, guardian, or legal custodian of a child, who is placing 23 the child under competent private instruction for the first 24 time, shall also provide the district with evidence that the 25 child has had the immunizations required under section 139A.8 , 26 and, if the child is elementary school age, a blood lead test 27 in accordance with section 135.105D . The term “outline of 28 course of study” shall include subjects covered, lesson plans, 29 and time spent on the areas of study. 30 Sec. ___. Section 299A.2, Code 2017, is amended to read as 31 follows: 32 299A.2 Competent private instruction by licensed 33 practitioner. 34 If a licensed practitioner provides competent instruction 35 -1- HF642.2465 (2) 87 kh/tm 1/ 4 #1.
to a school-age child, the practitioner shall possess a valid 1 license or certificate which has been issued by the state 2 board of educational examiners under chapter 272 and which is 3 appropriate to the ages and grade levels of the children to 4 be taught. Competent private instruction may include but is 5 not limited to a home school assistance program which provides 6 instruction or instructional supervision offered through an 7 accredited nonpublic school or public school district by a 8 teacher, who is employed by the accredited nonpublic school or 9 public school district, who assists and supervises a parent, 10 guardian, or legal custodian in providing instruction to a 11 child. If competent private instruction is provided through 12 a public school district, the child shall be enrolled and 13 included in the basic enrollment of the school district as 14 provided in section 257.6 . Sections 299A.3 through 299A.7 15 do not apply to competent private instruction provided by 16 a licensed practitioner under this section . However, the 17 reporting requirement contained in section 299A.3, subsection 18 1 , shall apply to competent private instruction provided by 19 licensed practitioners that is not part of a home school 20 assistance program offered through an accredited nonpublic 21 school or public school district. 22 Sec. ___. Section 299A.3, Code 2017, is amended to read as 23 follows: 24 299A.3 Private instruction by nonlicensed person. 25 A parent, guardian, or legal custodian of a child of 26 compulsory attendance age providing private instruction to the 27 child may meet all of do either of the following requirements : 28 1. Complete and send, in a timely manner, the report 29 required under section 299.4 to the school district of 30 residence of the child. 31 2. 1. Ensure that the child under the parent’s, guardian’s, 32 or legal custodian’s instruction is evaluated annually to 33 determine whether the child is making adequate progress, as 34 defined in section 299A.6 . 35 -2- HF642.2465 (2) 87 kh/tm 2/ 4

Ensure that the results of the child’s annual 1 evaluation are reported to the school district of residence 2 of the child and to the department of education by a date not 3 later than June 30 of each year in which the child is under 4 private instruction. 5 Sec. ___. NEW SECTION . 299A.13 Quarterly health and safety 6 meetings. 7 1. The board of directors of a school district shall 8 conduct quarterly meetings on the health and safety of children 9 located within the district who are receiving competent private 10 instruction or private instruction. These quarterly meetings 11 shall be held at a school building or office located within the 12 school district. 13 2. In lieu of the quarterly meetings required under 14 subsection 1, the parent, guardian, or legal custodian of a 15 child placed under private instruction in accordance with 16 this chapter may opt to provide proof of an annual health and 17 wellness examination with a physician as defined in section 18 135.1. The parent, guardian, or legal custodian shall annually 19 provide a statement or certificate signed by a physician, 20 certifying that the physician conducted a health and wellness 21 examination of the child within one month immediately prior to, 22 or during, the current school year. 23 3. The superintendent of the school district shall 24 designate a person to carry out the duties assigned to the 25 school district under this section. The person designated 26 shall be a mandatory reporter, as defined in section 232.69, 27 subsection 1. The school district may collaborate with the 28 department of human services, including the local, county, 29 and service area officers of the department, in conducting 30 the quarterly health and safety meetings required under this 31 section. 32 4. The department of education, in collaboration with the 33 department of human services, shall provide guidelines to 34 school districts for implementation of this section. 35 -3- HF642.2465 (2) 87 kh/tm 3/ 4
Sec. ___. NEW SECTION . 299A.14 Private instruction 1 prohibited —— conditions. 2 The parent, guardian, or legal custodian of a child of 3 compulsory attendance age shall not place a child under private 4 instruction under this chapter if a person living in the same 5 home as the child meets any of the following conditions: 6 1. Has been convicted of a crime that would disqualify an 7 otherwise qualified applicant for a license under chapter 272. 8 2. Is listed on the sex offender registry under chapter 9 692A. 10 3. Is on the central registry for child abuse information 11 established under section 235A.14. > 12 2.
