Section 331.301, subsection 6, Code 2017, is 5 amended by adding the following new paragraph: 6 NEW PARAGRAPH . c. A county may adopt an ordinance, motion, 7 resolution, or amendment that sets standards or requirements 8 regarding the sale or marketing of consumer merchandise 9 that are different from, or in addition to, any requirement 10 established by state law. For purposes of this paragraph: 11 (1) “Consumer merchandise” means merchandise offered for 12 sale or lease, or provided with a sale or lease, primarily but 13 not exclusively for personal, family, or household purposes, 14 and includes any container used for consuming, carrying, or 15 transporting such merchandise. 16 (2) “Container” means a bag, cup, package, container, 17 bottle, or other packaging that is all of the following: 18 (a) Designed to be either reusable or single-use. 19 (b) Made of cloth, paper, plastic, including foamed or 20 expanded plastic, cardboard, corrugated material, aluminum, 21 glass, or postconsumer recycled or similar material or 22 substrates, including coated, laminated, or multilayer 23 substrates. 24 (c) Designed for consuming, transporting, or protecting 25 merchandise, food, or beverages from or at a food service or 26 retail facility. 27 Sec. 2. Section 331.304, Code 2017, is amended by adding the 28 following new subsection: 29 NEW SUBSECTION . 12. A county may adopt, enforce, or 30 otherwise administer an ordinance, motion, resolution, or 31 amendment providing for any terms or conditions of employment 32 that exceed or conflict with the requirements of federal 33 or state law relating to a minimum or living wage rate, 34 any form of employment leave, hiring practices, employment 35 -1- HF295.1813 (2) 87 je/rj 1/ 3 #1.
benefits, scheduling practices, or other terms or conditions 1 of employment. 2 Sec. 3.
