(1)
Require
that
a
retailer
or
community

license
to
sell
consumer
fireworks,
as

described

APA
87-1,
chapter
3,
to
sell
and
store

consumer
fireworks
in
a
permanent
building
that
meets

all
of
the
following
requirements:

(a)
The
building
is
constructed
entirely
of
16
inflammable
materials.

(b)
The
building
is
equipped
with
fire
alarms
and
18
fire
sprinklers.
19
(c)
The
building
is
located
at
least
two
hundred
20
feet
away
from
any
other
structure.

(d)
No
other
business
operates
in
the
building.
22
(e)
The
location
and
construction
of
the
building
23
is
approved
by
the
state
fire
marshal
prior
to
the
sale
24
or
storage
of
any
consumer
fireworks.
25
(2)
The
state
fire
marshal
may
at
any
time
inspect
26
a
building
used
for
the
sale
or
storage
of
consumer
27
fireworks
to
ensure
compliance
with
this
paragraph
“d”
.
28
A
retailer
or
community
group
that
uses
a
building
for
29
the
sale
or
storage
of
consumer
fireworks
in
violation
30
of
this
paragraph
“d”
shall
be
fined
ten
thousand
31
dollars
and
shall
not
use
such
building
for
the
sale
32
or
storage
of
consumer
fireworks
until
the
state
33
fire
marshal
has
determined
that
the
building
is
in
34
compliance
with
all
applicable
requirements.
