MEDICAL MALPRACTICE INSURANCE STUDY. 5 1. The commissioner of insurance shall, in 6 consultation with representatives of the Iowa medical 7 society, the Iowa osteopathic medical association, the 8 Iowa hospital association, the Iowa nurses association, 9 the insurance industry, the Iowa state bar association, 10 the Iowa association for justice, and the Iowa defense 11 counsel association, conduct a study of malpractice 12 insurance premiums for medical providers in this state. 13 2. The study shall include a review of all of the 14 following: 15 a. The cost of medical malpractice premiums charged 16 to medical providers in this state. 17 b. The cost of medical malpractice premiums charged 18 to medical providers throughout the United States. 19 c. The transactional cost involved in providing 20 medical malpractice insurance, with reference to the 21 costs of premiums in this state and in the United 22 States. 23 d. Loss ratios of providers of medical malpractice 24 insurance. 25 e. The impact of various court reform proposals on 26 medical malpractice insurance, including evidence-based 27 medical practice guidelines, certificates of merit for 28 expert witnesses, and caps on noneconomic damages. 29 f. The frequency and severity of medical 30 malpractice litigation in this state, including the 31 number of civil suits filed and civil jury verdicts in 32 the area of medical malpractice. 33 3. The commissioner of insurance shall submit a 34 report to the governor and the general assembly by 35 -1- S3161.1569 (1) 87 jh/nh 1/ 2 #1.
