Section 48A.7, Code 2017, is amended to 3 read as follows: 4 48A.7 Registration in person. 5 An eligible elector may register to vote by 6 appearing personally and completing a voter 7 registration form at the office of the commissioner 8 in the county in which the person resides, at a motor 9 vehicle driver’s license station, including any county 10 treasurer’s office that is participating in county 11 issuance of driver’s licenses under chapter 321M , 12 or at any voter registration agency. A For paper 13 registration forms, a separate voter registration form 14 shall be signed by each individual registrant. 15 Sec. ___. Section 48A.8, subsection 1, Code 2017, 16 is amended to read as follows: 17 1. An eligible elector may request that a voter 18 registration form be mailed to the elector. The 19 completed form may be mailed or delivered by the 20 registrant or the registrant’s designee to the 21 commissioner in the county where the person resides or 22 to the state commissioner of elections for a program 23 participant, as provided in section 9E.6 . Section 48A.18, subsections 1 and 3, Code 27 2017, are amended to read as follows: 28 1. Each state motor vehicle driver’s license 29 application, including any renewal application 30 or application for a nonoperator’s identification 31 card, submitted to the office of driver services of 32 the state department of transportation shall serve 33 as an application for voter registration unless 34 the commissioner of registration determines that 35 -1- SF399.1466 (1) 87 aw/jh 1/ 6 #1.
the applicant is not an eligible elector or the 1 applicant declines to register to vote after receiving 2 notification under subsection 4A . A completed voter 3 registration form application submitted to the 4 office of driver services of the state department 5 of transportation shall be considered to update any 6 previous voter registration by the registrant. 7 3. Information relating to the refusal decision of 8 an applicant for a driver’s license to apply decline 9 to register to vote shall not be used for any purpose 10 other than voter registration. 11 Sec. ___. Section 48A.18, subsection 4, Code 2017, 12 is amended by striking the subsection and inserting in 13 lieu thereof the following: 14 4. a. The state voter registration commission 15 shall establish schedules by which the department of 16 transportation shall transmit to the state registrar of 17 voters electronic records containing the legal name, 18 date of birth, residential address, mailing address, 19 and social security number for each person submitting 20 an application under this section. 21 b. The state voter registration commission shall 22 establish schedules by which the state registrar of 23 voters shall make accessible or transmit electronic 24 records received under paragraph “a” to the appropriate 25 commissioner of registration. 26 c. The state commissioner of elections shall adopt 27 rules pursuant to chapter 17A, consistent with section 28 9E.6, for the registration of address confidentiality 29 program participants. 30 d. The state voter registration commission, in 31 consultation with the department of transportation, 32 shall adopt rules pursuant to chapter 17A to administer 33 and interpret this section, including rules to 34 establish electronic applications and procedures used 35 -2- SF399.1466 (1) 87 aw/jh 2/ 6
by the office of driver services for voter registration 1 purposes, rules to establish schedules for transmission 2 of electronic records, and rules and forms to decline 3 being registered to vote. 4 Sec. ___. Section 48A.18, Code 2017, is amended by 5 adding the following new subsection: 6 NEW SUBSECTION . 4A. a. (1) Upon receiving 7 the electronic record for a person under subsection 8 4, the state registrar of voters shall transmit or 9 otherwise make accessible the electronic record of the 10 person to the commissioner of registration where the 11 person resides. Upon reviewing the electronic record 12 received from the state registrar of voters, along with 13 any other relevant information, the commissioner of 14 registration shall determine if a person is an eligible 15 elector of the county. If the commissioner determines 16 that a person is an eligible elector of the county 17 and is not registered to vote in that county, the 18 commissioner shall notify the person of the separate 19 processes to decline being registered to vote or to 20 declare a political party affiliation. 21 (2) If the person is registered to vote in the 22 county, the commissioner shall use the electronic 23 record and information to update the person’s voter 24 registration if appropriate. 25 b. If a person notified under paragraph “a” does 26 not decline to be registered to vote within twenty-one 27 calendar days after the commissioner of registration 28 issues the notification, the person’s electronic record 29 and the electronic signature obtained by the department 30 of transportation shall constitute a completed voter 31 registration form under section 48A.11, and the 32 commissioner of registration shall register the person 33 to vote in that county. c. A commissioner of registration shall not add a 1 person subject to registration under this subsection 2 to a voter registration list until at least twenty-one 3 calendar days after the commissioner has issued 4 notification to the person as described in paragraph 5 “a” . 6 d. The electronic record and electronic signature 7 of a person who does not qualify as an eligible elector 8 shall not constitute a completed voter registration 9 form under section 48A.11 and such a person’s 10 application for a driver’s license or nonoperator’s 11 identification card shall not be considered to be a 12 voter registration application for purposes of section 13 39A.2, subsection 1, paragraph “a” . 14 Sec. ___. Section 48A.21, Code 2017, is amended to 15 read as follows: 16 48A.21 Transmission of forms from agencies and 17 driver’s license stations . 18 The state registrar of voters shall adopt 19 administrative rules regulating the transmission 20 of completed voter registration forms from voter 21 registration agencies and from driver’s license 22 stations, including county treasurer’s offices 23 participating in county issuance of driver’s licenses 24 under chapter 321M . All completed voter registration 25 applications in the possession of a voter registration 26 agency , a driver’s license station, or a county 27 treasurer’s office that is participating in county 28 issuance of driver’s licenses at 5:00 p.m. on the 29 last workday of each week shall be transmitted to the 30 location designated by the state registrar of voters 31 by rule. Procedures or requirements for more frequent 32 transmissions may be specified by rule. 33 Sec. ___. Section 48A.26, subsection 1, paragraph 34 b, Code 2017, is amended to read as follows: 35 -4- SF399.1466 (1) 87 aw/jh 4/ 6
b. (1) For a voter registration form or change of 1 information in a voter registration record submitted 2 at a precinct caucus, the commissioner shall send an 3 acknowledgment within forty-five days of receipt of the 4 form or change of information. 5 (2) For a voter registration application or 6 change of information in a voter registration record 7 completed pursuant to section 48A.18, subsection 4A, 8 the commissioner shall send an acknowledgment within 9 seven working days of the person being registered under 10 that subsection. 11 Sec. ___. Section 48A.26, subsection 8, Code 2017, 12 is amended to read as follows: 13 8. An A completed voter registration application, 14 improperly transmitted under section 48A.18, 15 subsection 4A, or an improperly addressed or delivered 16 registration form shall be transmitted or forwarded to 17 the appropriate county commissioner of registration 18 within two working days after it is received by any 19 other official. The date of registration shall be the 20 date the completed application or registration form was 21 received by the first official. If the registration 22 form was postmarked fifteen or more days before an 23 election and the registration form was received by the 24 first official after the close of registration, the 25 registration form shall be considered on time for the 26 election. > 27 2. otherwise, to the appropriate commissioner in 1 accordance with rules of the state voter registration 2 commission and the state registrar of voters. The 3 office of driver services of the state department 4 of transportation shall electronically transmit 5 registration data to the state registrar of voters as 6 required pursuant to section 48A.18. The state agency 7 originating the registration data shall permanently 8 retain an electronic copy of the form completed by the 9 registrant, including the registrant’s signature, and 10 shall develop procedures for the retrieval and printing 11 of that electronic document. A printed copy of an 12 electronic registration document shall be made only 13 upon the agency’s receipt of a court order. 14 Sec. ___. Section 331.557A, subsection 5, Code 15 2017, is amended to read as follows: 16 5. Participate in voter registration according to 17 the terms of chapter 48A , and submit completed voter 18 registration forms to the state registrar of voters 19 appropriate county commissioner of registration . 20 Sec. ___. IMPLEMENTATION OF ACT. Section 25B.2, 21 subsection 3, shall not apply to this division of this 22 Act. 23 Sec. ___. EFFECTIVE DATE. This division of this 24 Act takes effect January 1, 2018. > 25 3.
