NEW SECTION . 70A.41 Construction 4 projects funded by the state —— project labor agreements 5 prohibited. 6 1. For the purposes of this section: 7 a. “Construction project” means the construction, 8 rehabilitation, alteration, conversion, extension, 9 repair or improvement of a vertical public works 10 project, including a building and other real 11 property-related project. 12 b. “Governmental entity” means the state, political 13 subdivisions of the state, public school corporations, 14 and all officers, boards, or commissions empowered by 15 law to enter into contracts for construction projects. 16 c. “Labor organization” means an area or state 17 building and construction trades or crafts council, 18 organization, or association or a comparable body. 19 d. “Project labor agreement” means a comprehensive 20 pre-hire collective bargaining agreement that is 21 negotiated between a project’s owner and an appropriate 22 labor organization and sets out the basic terms and 23 working conditions for that particular project. 24 2. A governmental entity shall not enter into or 25 utilize a project labor agreement for any construction 26 project paid for in whole or in part with state 27 appropriations or any other state funds. > 28 2.
