Senate File 238 S-3087 Amend Senate File 238 as follows: 1 1. By striking everything after the enacting clause 2 and inserting: 3 < Section 1. Section 709.15, subsection 1, paragraph 4 f, Code 2017, is amended by striking the paragraph and 5 inserting in lieu thereof the following: 6 f. (1) “School employee” means any of the 7 following, except as provided in subparagraph (2): 8 (a) A person who holds a license, certificate, 9 or statement of professional recognition issued under 10 chapter 272. 11 (b) A person who holds an authorization issued 12 under chapter 272. 13 (c) A person employed by a school district 14 full-time, part-time, or as a substitute. 15 (d) A person who performs services as a volunteer 16 for a school district and who has direct supervisory 17 authority over the student with whom the person engages 18 in conduct prohibited under subsection 3, paragraph 19 “a” . 20 (e) A person who provides services under a contract 21 for such services to a school district and who has 22 direct supervisory authority over the student with 23 whom the person engages in conduct prohibited under 24 subsection 3, paragraph “a” . 25 (2) “School employee” does not include a student 26 enrolled in the school district. 27 Sec. 2. Section 709.15, subsection 3, Code 2017, is 28 amended by adding the following new paragraph: 29 NEW PARAGRAPH . c. The provisions of this 30 subsection do not apply to a person who is employed by 31 a school district attendance center if the student with 32 whom the person engages in conduct prohibited under 33 subsection 3, paragraph “a” , is not enrolled in the 34 same school district attendance center that employs the 35 -1- SF238.1129 (3) 87 kh/nh 1/ 2 #1.
