DEPARTMENT OF ADMINISTRATIVE SERVICES APPOINTMENT 32 OF INDEPENDENT INVESTIGATOR. The investigation shall include an analysis of 1 all expenses reimbursed by the state to the former director 2 of the authority and all employees of the authority for the 3 period January 1, 2011, through June 30, 2018. Such expenses 4 shall include all travel, lodging, meals, beverages, personal 5 services, entertainment, office expenses, and all other 6 expenditures not included in the authority’s budget. The 7 investigation shall also include an analysis of any personal 8 financial or other personal accounts used by the former 9 authority director or any employee of the authority to collect 10 agency fees or other moneys collected by the authority. In 11 addition, the investigation shall include a review of any 12 conduct of current and former authority employees in violation 13 of any state human resources policies or authority personnel 14 policies, or otherwise related to the termination of the 15 former director of the authority. The department shall submit 16 a report with a summary of the results of the independent 17 investigation to the general assembly no later than December 1, 18 2018. > 19 < DIVISION ___ 20 MISCELLANEOUS 21 Sec. ___. Section 8.57, subsection 5, paragraph f, 22 subparagraph (1), subparagraph division (c), Code 2018, is 23 amended to read as follows: 24 (c) (i) For the fiscal year beginning July 1, 2013, and for 25 each fiscal year thereafter through the fiscal year beginning 26 July 1, 2017 , of the wagering tax receipts received pursuant to 27 sections 99D.17 and 99F.11 , the next sixty-six million dollars 28 shall be deposited in the Iowa skilled worker and job creation 29 fund created in section 8.75 . 30 (ii) For the fiscal year beginning July 1, 2018, and for 31 each fiscal year thereafter, of the wagering tax receipts 32 received pursuant to sections 99D.17 and 99F.11, the next 33 sixty-three million seven hundred fifty thousand dollars shall 34 be deposited in the Iowa skilled worker and job creation fund 35 -2- HF2493.5690.S (1) 87 jh 2/ 4
created in section 8.75. 1 Sec. ___. Section 8.57, subsection 5, paragraph f, 2 subparagraph (1), Code 2018, is amended by adding the following 3 new subparagraph division: 4 NEW SUBPARAGRAPH DIVISION . (0d) For the fiscal year 5 beginning July 1, 2018, and for each fiscal year thereafter, of 6 the wagering tax receipts received pursuant to sections 99D.17 7 and 99F.11, the next two million two hundred fifty thousand 8 dollars shall be deposited in the general fund of the state. 9 Sec. ___. Section 8.57, subsection 5, paragraph f, 10 subparagraph (1), subparagraph division (d), Code 2018, is 11 amended to read as follows: 12 (d) For the fiscal year beginning July 1, 2013, 2018, and 13 for each fiscal year thereafter, the total moneys in excess of 14 the moneys deposited under this paragraph “f” in the revenue 15 bonds debt service fund, the revenue bonds federal subsidy 16 holdback fund, the vision Iowa fund, and the Iowa skilled 17 worker and job creation fund , and the general fund of the state 18 shall be deposited in the rebuild Iowa infrastructure fund and 19 shall be used as provided in this section , notwithstanding 20 section 8.60 . 21 Sec. ___. Section 96.5, Code 2018, is amended by adding the 22 following new subsection: 23 NEW SUBSECTION . 13. Overpayment resulting in 24 disqualification. If the department finds that an individual 25 has received benefits by reason of misrepresentation pursuant 26 to section 96.16, such individual shall be disqualified for 27 benefits until the balance of the benefits received by the 28 individual due to misrepresentation, including all penalties, 29 interest, and lien fees, is paid in full. 30 Sec. ___. NEW SECTION . 507E.2A Definition of insurer —— 31 workers’ compensation. 32 As used in this chapter, unless the context otherwise 33 requires: 34 1. “Insurance” means any and all contracts, arrangements, 35 -3- HF2493.5690.S (1) 87 jh 3/ 4
and agreements by or through which one party, for compensation, 1 assumes risks of another party and promises to pay the second 2 party or the second party’s nominee a certain or ascertainable 3 sum of money on the occurrence of a specified contingency. 4 “Insurance” includes any and all contracts, arrangements, or 5 agreements contemplated by, falling within, and coming under 6 section 87.11. Without limiting the foregoing, “insurance” 7 includes any contract of insurance, indemnity, subscription, 8 membership, suretyship, or annuity that has been issued, is 9 proposed for issuance, or is intended for issuance by any 10 person or entity. 11 2. “Insurer” includes an insurer that issues a policy of 12 workers’ compensation, a self-insured business for purposes of 13 workers’ compensation liability, or a group or self-insured 14 plan as described in section 87.4. > 15 -4- HF2493.5690.S (1) 87 jh 4/ 4
