The total amount recoverable by each plaintiff in any 8 civil action for noneconomic damages for personal injury, 9 whether in tort, contract, or otherwise, against a licensee 10 or permittee, shall be limited to two hundred fifty thousand 11 dollars for any injury or death of a person, unless the jury 12 determines that there is a substantial or permanent loss or 13 impairment of a bodily function, substantial disfigurement, 14 or death, which warrants a finding that imposition of such a 15 limitation would deprive the plaintiff of just compensation for 16 the injuries sustained. > 17 5. Page 1, before line 31 by inserting: 18 < Sec. ___. Section 123.92, Code 2018, is amended by adding 19 the following new subsection: 20 NEW SUBSECTION . 4. The division shall biennially conduct 21 an evaluation concerning minimum coverage requirements of 22 dramshop liability insurance. In conducting the evaluation, 23 the division shall include a comparison of other states’ 24 minimum dramshop liability insurance coverage and any other 25 relevant issues the division identifies. By January 31, 2019, 26 and every two years thereafter, the division shall submit a 27 report, including any findings and recommendations, to the 28 general assembly as provided in chapter 7A. > 29 6.
