Page 14, after line 27 by inserting: 2 < DIVISION ___ 3 PRESENCE OF SEX OFFENDER —— PUBLIC OR NONPUBLIC ELEMENTARY OR 4 SECONDARY SCHOOL 5 Sec. ___. Section 692A.109, subsection 1, paragraph g, Code 6 2018, is amended to read as follows: 7 g. Inform the sex offender who was convicted of a sex 8 offense against a minor of the prohibitions established under 9 section 692A.113 by providing the offender with a written 10 copy of section 692A.113 and relevant definitions of section 11 692A.101 . 12 Sec. ___. Section 692A.113, subsection 1, paragraph a, Code 13 2018, is amended by striking the paragraph. 14 Sec. ___. Section 692A.113, Code 2018, is amended by adding 15 the following new subsection: 16 NEW SUBSECTION . 4. A sex offender who has been convicted 17 of a sex offense or a person required to register as a sex 18 offender in another jurisdiction shall not be present upon the 19 real property of a public or nonpublic elementary or secondary 20 school unless any of the following apply: 21 a. (1) The sex offender has written permission of the 22 school administrator or school administrator’s designee to 23 be present upon the real property of a public or nonpublic 24 elementary or secondary school. 25 (2) A school administrator or the school administrator’s 26 designee shall not unreasonably withhold issuing written 27 permission under this paragraph. 28 b. The sex offender is enrolled as a student at the school. 29 c. The sex offender is the parent or legal guardian of a 30 minor and is present on the real property solely during the 31 period of time reasonably necessary to transport the offender’s 32 own minor child or ward to or from the school. 33 d. The sex offender is entitled to vote and is present on 34 the real property solely for the period of time reasonably 35 -1- H8171.4477 (1) 87 hb/rh 1/ 2 #1.
