Section 261.87, subsection 1, Code 2018, is 13 amended by adding the following new paragraph: 14 NEW PARAGRAPH . 0d. “Eligible surviving-child student” means 15 a qualified student who is under the age of twenty-six, or 16 under the age of thirty if the student is a veteran who is 17 eligible for benefits, or has exhausted the benefits, under the 18 federal Post-9/11 Veterans Educational Assistance Act of 2008; 19 who is not a convicted felon as defined in section 910.15; and 20 who meets any of the following criteria: 21 (1) Is the child of a peace officer, as defined in section 22 97A.1, who was killed in the line of duty as determined by 23 the board of trustees of the Iowa department of public safety 24 peace officers’ retirement, accident, and disability system in 25 accordance with section 97A.6, subsection 16. 26 (2) Is the child of a police officer or a fire fighter, as 27 each is defined in section 411.1, who was killed in the line of 28 duty as determined by the statewide fire and police retirement 29 system in accordance with section 411.6, subsection 15. 30 (3) Is the child of a sheriff or deputy sheriff as each is 31 defined in section 97B.49C, who was killed in the line of duty 32 as determined by the Iowa public employees’ retirement system 33 in accordance with section 97B.52, subsection 2. 34 (4) Is the child of a fire fighter or police officer 35 -1- HF2351.3572 (4) 87 kh/rn 1/ 2 #1. #2. #3. #4.
