By
striking
page
5,
line
22,
through
page

and

(1)
Prior
to
a
local
authority
placing
an
automated
5
traffic
law
enforcement
system
on
a
primary
road,
the
local
6
authority
shall
obtain
approval
from
the
department
in
7
accordance
with
rules
adopted
by
the
department.
A
local
8
authority
shall
submit
to
the
department
any
information
9
requested
by
the
department
during
the
approval
process.
If
10
the
local
authority’s
use
of
the
system
is
approved
by
the
11
department,
the
local
authority
shall
follow
the
requirements
12
set
forth
in
rules
adopted
by
the
department.
The
department
13
may
modify
its
rules
relating
to
automated
traffic
law
14
enforcement
systems
to
the
extent
necessary
to
ensure
automated
15
traffic
law
enforcement
systems
are
operated
in
a
safe
and
16
equitable
manner.
The
department
may
annually
review
all
17
automated
traffic
law
enforcement
systems
placed
on
primary
18
roads
and
may
require
the
removal
or
modification
of
such
19
systems.
This
subparagraph
(1)
shall
not
apply
to
an
automated
20
traffic
law
enforcement
system
approved
or
allowed
to
operate
21
in
accordance
with
rules
adopted
by
the
department
and
in
22
operation
prior
to
January
1,
2017.
A
local
authority
may
23
continue
to
operate
such
a
system
in
the
same
manner
as
the
24
system
was
operated
prior
to
January
1,
2017.
However,
after
a
25
local
authority
discontinues
operation
or
alters
the
manner
of
26
operation
of
such
a
system,
any
new
manner
of
operation
or
new
27
system
operated
by
the
local
authority
shall
comply
with
this
28
subparagraph
(1).

(2)
On
or
before
July
1,
2019,
a
local
authority,
or
30
another
entity
on
a
local
authority’s
behalf,
operating
an
31
automated
traffic
law
enforcement
system
on
a
primary
road
32
shall
discontinue
operating
the
system
and
remove
the
system
33
equipment.
On
and
after
July
1,
2019,
a
local
authority
shall
34
not
place,
cause
to
be
placed,
operate,
maintain,
or
employ
the

LOCAL
ORDINANCES
VOID

VALIDITY
OF
PRIOR
4
NOTICES
AND
CITATIONS.
On
and
after
July
1,
2017,
all
local
5
ordinances
governing
automated
traffic
law
enforcement
systems
6
inconsistent
with
this
Act
are
void.
However,
any
notice
of
7
violation
mailed
or
any
citation
issued
pursuant
to
such
an
8
ordinance
prior
to
July
1,
2017,
shall
not
be
invalidated
by
9
the
enactment
of
this
Act
and
shall
be
processed
according
to
10
the
provisions
of
the
law
under
which
it
was
authorized.
11
Sec.

EFFECTIVE
UPON
ENACTMENT.
The
section
of
this
Act
12
relating
to
the
validity
of
prior
notices
and
citations,
being
13
deemed
of
immediate
importance,
takes
effect
upon
enactment.
