NEW SECTION . 283A.11 Participation by students —— 6 school prohibitions and responsibilities. 7 1. For purposes of this section, unless the context 8 otherwise requires, “school” includes a school district, a 9 school district attendance center, or an accredited nonpublic 10 school. 11 2. A school shall provide notice, at least twice annually, 12 to the parents or guardians of all enrolled students regarding 13 the availability of applications for free or reduced-fee meals 14 for categorically eligible students under the federal Richard 15 B. Russell National School Lunch Act of 1966, 42 U.S.C. §1751 16 et seq., and the federal Child Nutrition Act of 1966, 42 U.S.C. 17 §1771 et seq. Notice may be provided via letter or electronic 18 communication. 19 3. If a student owes money for five or more meals, a school 20 principal, assistant principal, or designated meal program 21 staff person may contact the student’s parent or guardian to 22 provide information regarding the application for free or 23 reduced-fee meals pursuant to the federal Richard B. Russell 24 National School Lunch Act of 1966, 42 U.S.C. §1751 et seq., 25 and the federal Child Nutrition Act of 1966, 42 U.S.C. §1771 26 et seq.; or provide information on other options or assistance 27 available. 28 4. a. A school is prohibited from engaging in any of the 29 following acts: 30 (1) Publicly identifying or stigmatizing a student who 31 cannot pay for a meal or who owes a meal debt, including but not 32 limited to requiring such a student to consume the meal at a 33 table set aside for such purpose. 34 (2) Requiring a student who cannot pay for a meal or 35 -1- SF475.2567 (2) 87 kh/rj 1/ 2 #1.
who owes a meal debt to do chores or other work to pay for 1 meals, unless chores or other work is required of all students 2 regardless of a meal debt. However, a student may volunteer to 3 perform chores or other work at the school. 4 b. A school shall direct communications about a student’s 5 meal debt to a parent or guardian and not to the student. This 6 paragraph does not prohibit a school from sending a letter home 7 with a student addressed to the student’s parent or guardian, 8 or from contacting the parent or guardian via phone or other 9 electronic means. 10 5. The department of education shall, in consultation with 11 schools, develop and establish best practices, guidance, and 12 policies to assist schools to reach the goal of ensuring that 13 all students have access to nutritionally adequate meals, as 14 defined in section 283A.1, at school. > 15 2.
