NEW SECTION . 283A.11 Participation by students —— 6 school prohibitions and responsibilities. 7 1. For purposes of this section, unless the context 8 otherwise requires, “school” includes a school district, a 9 school district attendance center, or an accredited nonpublic 10 school. 11 2. a. A school shall serve nutritious meals to students 12 without discriminating based on ability to pay for a meal and 13 shall not require a student to throw a meal away after the meal 14 has been served for any of the following reasons: 15 (1) The student is unable to pay for the meal. 16 (2) The student, or the student’s family, owes money for 17 meals previously provided to the student. 18 b. If a student owes money for five or more meals, a school 19 shall do all of the following: 20 (1) Require a principal, assistant principal, or designated 21 meal program staff person to contact the parent or guardian to 22 offer assistance with an application for free or reduced-fee 23 meals pursuant to the federal Richard B. Russell National 24 School Lunch Act of 1966, 42 U.S.C. §1751 et seq., and the 25 federal Child Nutrition Act of 1966, 42 U.S.C. §1771 et seq.; 26 and then determine, if appropriate, if other issues within the 27 household have caused the student to have insufficient funds 28 to purchase a school meal; and offer any other assistance that 29 is appropriate. 30 (2) Check the state list of students categorically eligible 31 for free meals to determine if the student is categorically 32 eligible. 33 (3) Make at least two attempts to reach the student’s parent 34 or guardian to discuss filling out an application for free or 35 -1- SF475.2472 (2) 87 kh/rj 1/ 2 #1.

A school is prohibited from engaging in any of the 5 following acts: 6 (1) Publicly identifying or stigmatizing a student who 7 cannot pay for a meal or who owes a meal debt, including but not 8 limited to requiring such a student to consume the meal at a 9 table set aside for such purpose. 10 (2) Requiring a student who cannot pay for a meal or who 11 owes a meal debt to do chores or other work to pay for meals, 12 unless chores or work is required of all students regardless 13 of a meal debt. However, a student may volunteer to perform 14 chores at the school. 15 b. A school shall direct communications about a student’s 16 meal debt to a parent or guardian and not to the student. 17 Nothing in this paragraph prohibits a school from sending a 18 letter home with a student addressed to a parent or guardian. > 19 2.
