In addition to the full-time 1 equivalent positions authorized pursuant to this paragraph, 2 5.00 full-time equivalent positions are authorized and shall 3 be used by the department of justice to employ one accountant 4 and four program planners. The department of justice may 5 employ the additional 5.00 full-time equivalent positions 6 authorized pursuant to this paragraph that are in excess of the 7 number of full-time equivalent positions authorized only if 8 the department of justice receives sufficient federal moneys 9 to maintain employment for the additional full-time equivalent 10 positions during the current fiscal year. The department 11 of justice shall only employ the additional 5.00 full-time 12 equivalent positions in succeeding fiscal years if sufficient 13 federal moneys are received during each of those succeeding 14 fiscal years. 15 The department of justice shall transfer at least $150,000 16 from the victim compensation fund established in section 915.94 17 to the victim assistance grant program. 18 Notwithstanding section 8.33, moneys appropriated in this 19 paragraph “b” that remain unencumbered or unobligated at the 20 close of the fiscal year shall not revert but shall remain 21 available for expenditure for the purposes designated until the 22 close of the succeeding fiscal year. 23 c. The department of justice, in submitting budget 27 estimates for the fiscal year commencing July 1, 2018, pursuant 28 to section 8.23, shall include a report of funding from sources 29 other than amounts appropriated directly from the general fund 30 of the state to the department of justice or to the office of 31 consumer advocate. These funding sources shall include but 32 are not limited to reimbursements from other state agencies, 33 commissions, boards, or similar entities, and reimbursements 34 from special funds or internal accounts within the department 35 -2- HF644.2396 (2) 87 jm/rn 2/ 40

The department of justice shall also report actual 1 reimbursements for the fiscal year commencing July 1, 2017, 2 and actual and expected reimbursements for the fiscal year 3 commencing July 1, 2018. 4 b. The department of justice shall include the report 5 required under paragraph “a”, as well as information regarding 6 any revisions occurring as a result of reimbursements actually 7 received or expected at a later date, in a report to the 8 co-chairpersons and ranking members of the joint appropriations 9 subcommittee on the justice system and the legislative services 10 agency. The department of justice shall reimburse the 13 costs and necessary related expenses incurred by the Iowa 14 law enforcement academy to employ one additional instructor 15 position who shall provide training for domestic abuse and 16 human trafficking-related issues throughout the state. 17 b. The department of justice shall obtain the moneys 18 necessary to reimburse the Iowa law enforcement academy to 19 employ such an instructor from unrestricted moneys from either 20 the victim compensation fund established in section 915.94, the 21 human trafficking victim fund established in section 915.95, or 22 the human trafficking enforcement fund established in 2015 Iowa 23 Acts, chapter 138, section 141. 24 Sec. 2. It is the intent of the general assembly that as a 20 condition of receiving the appropriation provided in this 21 subsection the department of corrections shall not enter into 22 a lease or contractual agreement pursuant to section 904.809 23 with a private corporation for the use of building space for 24 the purpose of providing inmate employment without providing 25 that the terms of the lease or contract establish safeguards to 26 restrict, to the greatest extent feasible, access by inmates 27 working for the private corporation to personal identifying 28 information of citizens. 29 2. services, within the funding available, shall continue programs 1 and plans established within that district to provide for 2 intensive supervision, sex offender treatment, diversion of 3 low-risk offenders to the least restrictive sanction available, 4 job development, and expanded use of intermediate criminal 5 sanctions. 6 3. Each judicial district department of correctional 7 services shall provide alternatives to prison consistent with 8 chapter 901B. The alternatives to prison shall ensure public 9 safety while providing maximum rehabilitation to the offender. 10 A judicial district department of correctional services may 11 also establish a day program. 12 4. The governor’s office of drug control policy shall 13 consider federal grants made to the department of corrections 14 for the benefit of each of the eight judicial district 15 departments of correctional services as local government 16 grants, as defined pursuant to federal regulations. 17 5. The department of corrections shall continue to contract 18 with a judicial district department of correctional services to 19 provide for the rental of electronic monitoring equipment which 20 shall be available statewide. 21 Sec. 7. DEPARTMENT OF CORRECTIONS —— REALLOCATION OF 22 APPROPRIATIONS. Notwithstanding section 8.39, within the 23 moneys appropriated in this division of this Act to the 24 department of corrections, the department may reallocate the 25 moneys appropriated and allocated as necessary to best fulfill 26 the needs of the correctional institutions, administration 27 of the department, and the judicial district departments of 28 correctional services. However, in addition to complying with 29 the requirements of sections 904.116 and 905.8 and providing 30 notice to the legislative services agency, the department 31 of corrections shall also provide notice to the department 32 of management, prior to the effective date of the revision 33 or reallocation of an appropriation made pursuant to this 34 section. The department of corrections shall not reallocate an 35 -9- HF644.2396 (2) 87 jm/rn 9/ 40
appropriation or allocation for the purpose of eliminating any 1 program. 2 Sec. 8. INTENT —— REPORTS. 3 1. The department of corrections in cooperation with 4 townships, the Iowa cemetery associations, and other nonprofit 5 or governmental entities may use inmate labor during the 6 fiscal year beginning July 1, 2017, to restore or preserve 7 rural cemeteries and historical landmarks. The department in 8 cooperation with the counties may also use inmate labor to 9 clean up roads, major water sources, and other water sources 10 around the state. 11 2. On a quarterly basis the department shall provide a 12 status report regarding private-sector employment to the 13 legislative services agency beginning on July 1, 2017. The 14 report shall include the number of offenders employed in the 15 private sector, the combined number of hours worked by the 16 offenders, the total amount of allowances, and the distribution 17 of allowances pursuant to section 904.702, including any moneys 18 deposited in the general fund of the state. 19 Sec. 9. ELECTRONIC MONITORING REPORT. The department of 20 corrections shall submit a report on electronic monitoring to 21 the general assembly, to the co-chairpersons and the ranking 22 members of the joint appropriations subcommittee on the justice 23 system, and to the legislative services agency by January 24 15, 2018. The report shall specifically address the number 25 of persons being electronically monitored and break down the 26 number of persons being electronically monitored by offense 27 committed. The report shall also include a comparison of any 28 data from the prior fiscal year with the current year. 29 Sec. 10. STATE AGENCY PURCHASES FROM PRISON INDUSTRIES. 30 1. As used in this section, unless the context otherwise 31 requires, “state agency” means the government of the state 32 of Iowa, including but not limited to all executive branch 33 departments, agencies, boards, bureaus, and commissions, the 34 judicial branch, the general assembly and all legislative 35 -10- HF644.2396 (2) 87 jm/rn 10/ 40
agencies, institutions within the purview of the state board of 1 regents, and any corporation whose primary function is to act 2 as an instrumentality of the state. 3 2. State agencies are encouraged to purchase products from 4 Iowa state industries, as defined in section 904.802, when 5 purchases are required and the products are available from 6 Iowa state industries. State agencies shall obtain bids from 7 Iowa state industries for purchases of office furniture during 8 the fiscal year beginning July 1, 2017, exceeding $5,000 or 9 in accordance with applicable administrative rules related to 10 purchases for the agency. 11 Sec. 11. IOWA LAW ENFORCEMENT ACADEMY. 12 1. The Iowa law enforcement academy may select at least 30 five automobiles of the department of public safety, division 31 of state patrol, prior to turning over the automobiles to 32 the department of administrative services to be disposed 33 of by public auction, and the Iowa law enforcement academy 34 may exchange any automobile owned by the academy for each 35 -11- HF644.2396 (2) 87 jm/rn 11/ 40
automobile selected if the selected automobile is used in 1 training law enforcement officers at the academy. However, any 2 automobile exchanged by the academy shall be substituted for 3 the selected vehicle of the department of public safety and 4 sold by public auction with the receipts being deposited in the 5 depreciation fund to the credit of the department of public 6 safety, division of state patrol. 7 3. The Iowa law enforcement academy shall provide training 8 for domestic abuse and human trafficking-related issues 9 throughout the state. The training shall be offered at no 10 cost to the attendees and the training shall not replace any 11 existing domestic abuse or human trafficking training offered 12 by the academy. 13 Sec. 12. Expenses related to survivor outreach 28 activities supported by the department of public defense 29 established in section 29.1. 30 Sec. 22. NEW SECTION . 80B.19 Academy internal training fund 31 clearing account. 32 1. Activities of the academy shall be accounted for within 33 the general fund of the state, except the academy may establish 34 and maintain an internal training clearing fund in accordance 35 -19- HF644.2396 (2) 87 jm/rn 19/ 40
with generally accepted accounting principles, as defined in 1 section 8.57, subsection 4, for activities of the academy 2 which are primarily from billings to governmental entities for 3 services rendered by the academy. 4 2. Internal training funds in the internal training 5 clearing fund shall be administered by the academy and shall 6 consist of moneys collected by the academy from billings issued 7 in accordance with chapter 80B, and any other moneys obtained 8 or accepted by the academy, including but not limited to gifts, 9 loans, donations, grants, and contributions, which are obtained 10 or designated to support the activities of the academy. 11 3. The proceeds of an internal training clearing fund 12 established pursuant to this section shall be used by the 13 academy and expended through the appropriated account of the 14 academy for the operations of the academy consistent with this 15 chapter. However, this usage requirement shall not limit or 16 restrict the academy from using proceeds from gifts, loans, 17 donations, grants, and contributions in conformance with any 18 conditions, directions, limitations, or instructions attached 19 or related thereto. 20 4. Section 8.33 does not apply to any moneys in the internal 21 training clearing fund established pursuant to this section. 22 Notwithstanding section 12C.7, subsection 2, interest or 23 earnings on moneys deposited in the fund shall be credited to 24 the fund. 25 Sec. 23. Section 805.6, subsection 4, paragraphs a, b, and 26 c, Code 2017, are amended to read as follows: 27 a. If the offense is one to which an assessment of a minimum 28 fine is applicable and the entry is otherwise not prohibited 29 by this section , an amount equal to one and one-half times the 30 minimum fine and applicable surcharge assessed pursuant to 31 chapter 911, plus court costs. 32 b. If the offense is one to which a scheduled fine is 33 applicable, an amount equal to one and one-half times the 34 scheduled fine and applicable surcharge assessed pursuant to 35 -20- HF644.2396 (2) 87 jm/rn 20/ 40
chapter 911, plus court costs. 1 c. If the violation is for any offense for which a court 2 appearance is mandatory, and an assessment of a minimum fine 3 is not applicable, the amount of one hundred dollars and 4 applicable surcharge assessed pursuant to chapter 911, plus 5 court costs. 6 Sec. 24. 2014 Iowa Acts, chapter 1138, section 21, as 7 amended by 2016 Iowa Acts, chapter 1137, section 18, is amended 8 to read as follows: 9 SEC. 21. The department of justice shall also report actual 25 reimbursements for the fiscal year commencing July 1, 2017, 26 and actual and expected reimbursements for the fiscal year 27 commencing July 1, 2018. 28 b. The department of justice shall include the report 29 required under paragraph “a”, as well as information regarding 30 any revisions occurring as a result of reimbursements actually 31 received or expected at a later date, in a report to the 32 co-chairpersons and ranking members of the joint appropriations 33 subcommittee on the justice system and the legislative services 34 agency. Sec. 32. DEPARTMENT OF CORRECTIONS —— REALLOCATION OF 1 APPROPRIATIONS. Notwithstanding section 8.39, within the 2 moneys appropriated in this division of this Act to the 3 department of corrections, the department may reallocate the 4 moneys appropriated and allocated as necessary to best fulfill 5 the needs of the correctional institutions, administration 6 of the department, and the judicial district departments of 7 correctional services. However, in addition to complying with 8 the requirements of sections 904.116 and 905.8 and providing 9 notice to the legislative services agency, the department 10 of corrections shall also provide notice to the department 11 of management, prior to the effective date of the revision 12 or reallocation of an appropriation made pursuant to this 13 section. The department of corrections shall not reallocate an 14 appropriation or allocation for the purpose of eliminating any 15 program. 16 Sec. 33. INTENT —— REPORTS. 17 1. The department of corrections in cooperation with 18 townships, the Iowa cemetery associations, and other nonprofit 19 or governmental entities may use inmate labor during the 20 fiscal year beginning July 1, 2018, to restore or preserve 21 rural cemeteries and historical landmarks. The department in 22 cooperation with the counties may also use inmate labor to 23 clean up roads, major water sources, and other water sources 24 around the state. 25 2. On a quarterly basis the department shall provide a 26 status report regarding private-sector employment to the 27 legislative services agency beginning on July 1, 2018. The 28 report shall include the number of offenders employed in the 29 private sector, the combined number of hours worked by the 30 offenders, the total amount of allowances, and the distribution 31 of allowances pursuant to section 904.702, including any moneys 32 deposited in the general fund of the state. 33 Sec. 34. ELECTRONIC MONITORING REPORT. The department of 34 corrections shall submit a report on electronic monitoring to 35 -30- HF644.2396 (2) 87 jm/rn 30/ 40
the general assembly, to the co-chairpersons and the ranking 1 members of the joint appropriations subcommittee on the justice 2 system, and to the legislative services agency by January 3 15, 2019. The report shall specifically address the number 4 of persons being electronically monitored and break down the 5 number of persons being electronically monitored by offense 6 committed. The report shall also include a comparison of any 7 data from the prior fiscal year with the current year. 8 Sec. 35. STATE AGENCY PURCHASES FROM PRISON INDUSTRIES. 9 1. As used in this section, unless the context otherwise 10 requires, “state agency” means the government of the state 11 of Iowa, including but not limited to all executive branch 12 departments, agencies, boards, bureaus, and commissions, the 13 judicial branch, the general assembly and all legislative 14 agencies, institutions within the purview of the state board of 15 regents, and any corporation whose primary function is to act 16 as an instrumentality of the state. 17 2. State agencies are encouraged to purchase products from 18 Iowa state industries, as defined in section 904.802, when 19 purchases are required and the products are available from 20 Iowa state industries. State agencies shall obtain bids from 21 Iowa state industries for purchases of office furniture during 22 the fiscal year beginning July 1, 2018, exceeding $5,000 or 23 in accordance with applicable administrative rules related to 24 purchases for the agency. 25 Sec. 36. IOWA LAW ENFORCEMENT ACADEMY. 26 1.
