Section 256.42, subsection 7, Code 2017, is 12 amended by striking the subsection and inserting in lieu 13 thereof the following: 14 7. a. The provisions of section 256.11, subsection 5, which 15 require that specified subjects be offered and taught by a 16 school district or accredited nonpublic school, shall not apply 17 for up to two specified subjects at a school district or school 18 under this section if either of the following apply: 19 (1) The school district or school makes every reasonable and 20 good faith effort to employ a teacher licensed under chapter 21 272 for the specified subject, and is unable to employ such a 22 teacher. 23 (2) Fewer than ten students typically register for 24 instruction in the specified subject at the school district or 25 school. 26 b. The department may waive for one school year the 27 applicability of section 256.11, subsection 5, at its 28 discretion, to additional specified subject areas for a school 29 district or accredit nonpublic school that proves to the 30 satisfaction of the department that the school district or 31 school has made every reasonable effort, but is unable to meet 32 the requirements of section 256.11, subsection 5. c. Any specified subject course to which section 256.11, 1 subsection 5, does not apply under paragraph “a” or “b” shall be 2 provided by the initiative unless the course is not offered by 3 the initiative or the course offered by the initiative lacks 4 the capacity to accommodate additional students. In that 5 case, the specified subject course may instead be provided by 6 the school district or accredited nonpublic school through an 7 online learning platform, provided the online learning platform 8 is taught by an Iowa licensed teacher with online learning 9 experience and the course content is aligned with the Iowa 10 content standards and satisfies the requirements of subsection 11 6. 12 d. For purposes of this subsection, “good faith effort” 13 means the same as defined in section 279.19A, subsection 9. > 14 3.
