PATIENT COMPENSATION FUND STUDY. 4 1. The commissioner of insurance shall, in consultation 5 with representatives of the Iowa medical society, the Iowa 6 osteopathic medical association, the Iowa hospital association, 7 the Iowa nurses association, the Iowa medical mutual 8 insurance company, the insurance industry, the Iowa state bar 9 association, the Iowa association for justice, and the Iowa 10 defense counsel association, conduct a study regarding the 11 establishment and implementation of a patient compensation fund 12 by this state. 13 2. The commissioner of insurance shall submit a report 14 to the governor and general assembly by December 15, 2017, 15 detailing the findings of the study and recommendations for any 16 proposed legislation. The study shall include the following: 17 a. The effect of patient compensation funds on medical 18 malpractice premiums in states with such funds. 19 b. The estimated effect on medical malpractice premiums in 20 this state if a patient compensation fund is established and 21 implemented. 22 c. The university of Iowa hospitals and clinics’ experience 23 with partial self-insurance with the Iowa medical mutual 24 insurance company. 25 d. Proposals to set a maximum amount of liability a health 26 care provider may be subject to for a malpractice claim, any 27 exceptions to that maximum amount, and the estimated effect of 28 such a maximum amount on medical malpractice premiums in this 29 state. 30 e. Proposals to set a maximum amount of recovery for a 31 plaintiff with respect to a medical malpractice action, any 32 exceptions to that maximum amount, and the estimated effect of 33 such a maximum amount on medical malpractice premiums in this 34 state. 35 -1- SF465.2238 (2) 87 jh/nh 1/ 2 #1.
f. The types of health care providers that may participate 1 in the patient compensation fund. 2 g. The mechanism through which surcharges for participation 3 in the fund may be collected and deposited into the patient 4 compensation fund. 5 h. Whether participation in the patient compensation fund 6 should be mandatory or voluntary. 7 i. Proposals for the management and administration of the 8 patient compensation fund. 9 j.
