House File 20 H-1330 Amend the amendment, H-1006, to House File 20 as follows: 1 1. Page 1, by striking lines 2 through 9 and inserting: 2 < ___. By striking everything after the enacting clause and 3 inserting: 4 < Section 1. Section 709.15, subsection 1, paragraph f, Code 5 2017, is amended by striking the paragraph and inserting in 6 lieu thereof the following: 7 f. (1) “School employee” means any of the following, except 8 as provided in subparagraph (2): 9 (a) A person who holds a license, certificate, or statement 10 of professional recognition issued under chapter 272. 11 (b) A person who holds an authorization issued under chapter 12 272. 13 (c) A person employed by a school district full-time, 14 part-time, or as a substitute. 15 (d) A person who performs services as a volunteer for a 16 school district and who has direct supervisory authority over 17 the student with whom the person engages in conduct prohibited 18 under subsection 3, paragraph “a” . 19 (e) A person who provides services under a contract for such 20 services to a school district and who has direct supervisory 21 authority over the student with whom the person engages in 22 conduct prohibited under subsection 3, paragraph “a” . 23 (2) “School employee” does not include a student enrolled 24 in the school district. 25 Sec. 2. Section 709.15, subsection 3, Code 2017, is amended 26 by adding the following new paragraph: 27 NEW PARAGRAPH . c. The provisions of this subsection do 28 not apply to a person who is employed by a school district 29 attendance center if the student with whom the person engages 30 in conduct prohibited under subsection 3, paragraph “a” , is not 31 enrolled in the same school district attendance center that 32 employs the person, the person does not have direct supervisory 33 authority over the student, and the person does not meet the 34 requirements of subsection 1, paragraph “f” , subparagraph (1), 35 -1- H1006.2248 (1) 87 (amending this HF 20 to CONFORM to SF 238) kh/nh 1/ 2 #1.
