This section shall not apply to the any of the 5 following: 6 a. The termination of a human pregnancy performed by a 7 physician licensed in this state to practice medicine or 8 surgery or osteopathic medicine or surgery when in the best 9 clinical judgment of the physician the termination is performed 10 to preserve the life or health of the pregnant person or of the 11 fetus and every reasonable medical effort not inconsistent with 12 preserving the life of the pregnant person is made to preserve 13 the life of a viable fetus. 14 b. The termination of a human pregnancy performed when 15 the attending physician certifies that the fetus has a fetal 16 anomaly. 17 c. The termination of a human pregnancy performed when the 18 attending physician certifies that the pregnancy is the result 19 of incest. 20 d. The termination of a human pregnancy performed when the 21 attending physician certifies that the pregnancy is the result 22 of rape. 23 e. The termination of a human pregnancy performed when the 24 attending physician certifies that the pregnant woman has a 25 condition which the physician deems a medical emergency. 26 f. A medical procedure performed to preserve the life or 27 prevent the death of a pregnant woman that results in the 28 accidental or unintentional termination of the fetus. > 29 2.
