shall

Medicaid
family
planning
network
waiver

effective
July
1,
2016,
and
shall
instead
establish
2
a
state
family
planning
services
program.
The
state
3
program
shall
replicate
the
eligibility
requirements
4
and
other
provisions
included
in
the
Medicaid
family
5
planning
network
waiver
as
approved
by
the
centers
for
6
Medicare
and
Medicaid
services
of
the
United
States
7
department
of
health
and
human
services
in
effect
on
8
June
30,
2016,
but
shall
provide
for
distribution
9
of
the
family
planning
services
program
funds
in
10
accordance
with
this
section.

2.
Distribution
of
family
planning
services
program
12
funds
shall
be
made
to
eligible
applicants
in
the
13
following
order
of
priority:
14
a.
Public
entities
that
provide
family
planning
15
services
including
state,
county,
or
local
community
16
health
clinics
and
federally
qualified
health
centers.
17
b.
Nonpublic
entities
that,
in
addition
to
family
18
planning
services,
provide
required
primary
health
19
services
as
described
in
42
U.S.C.
§254b(b)(1)(A).

c.
Nonpublic
entities
that
provide
family
planning
21
services
but
do
not
provide
required
primary
health
22
services
as
described
in
42
U.S.C.
§254b(b)(1)(A).

3.
Distribution
of
family
planning
services
program
24
funds
under
this
section
shall
be
made
in
a
manner
that
25
continues
access
to
family
planning
services.
26
4.
Distribution
of
family
planning
services
program
27
funds
shall
not
be
made
to
any
entity
that
performs
28
abortions
or
that
maintains
or
operates
a
facility
29
where
abortions
are
performed.
For
the
purposes
of
30
this
section,
“abortion”
does
not
include
any
of
the
31
following:
32
a.
The
treatment
of
a
woman
for
a
physical
33
disorder,
physical
injury,
or
physical
illness,
34
including
a
life-endangering
physical
condition
caused

arising
from
the
pregnancy
itself,
that
would,

certified
by
a
physician,

the
woman
in
danger

when
not
all
5
of
the
products
of
human
conception
are
expelled.

Family
planning
services
program
funds

distributed
in
accordance
with
this
section
shall
8
not
be
used
for
direct
or
indirect
costs,
including
9
but
not
limited
to
administrative
costs
or
expenses,
10
overhead,
employee
salaries,
rent,
and
telephone
and
11
other
utility
costs,
related
to
providing
abortions
as
12
specified
in
subsection
4.
13
6.
The
department
of
human
services
shall
submit
14
a
report
to
the
governor
and
the
general
assembly,
15
annually
by
January
1,
listing
any
entities
that
16
received
funds
pursuant
to
subsection
2,
paragraph
17
“c”,
and
the
amount
and
type
of
funds
received
by
such
18
entities
during
the
preceding
calendar
year.
The
19
report
shall
provide
a
detailed
explanation
of
how
20
the
department
determined
that
distribution
of
family
21
planning
services
program
funds
to
such
an
entity,
22
instead
of
to
an
entity
described
in
subsection
2,
23
paragraph
“a”
or
“b”,
was
necessary
to
prevent
severe
24
limitation
or
elimination
of
access
to
family
planning
25
services
in
the
region
of
the
state
where
the
entity
26
is
located.
