House File 2459 S-5171 Amend the amendment, S-5157, to House File 2459, 1 as amended, passed, and reprinted by the House, as 2 follows: 3 1. Page 7, after line 29 by inserting: 4 < Sec. ___. Section 364.16, Code 2016, is amended to 5 read as follows: 6 364.16 Municipal fire protection. 7 Each city shall provide for the protection of 8 life and property against fire and may establish, 9 house, equip, staff, uniform, and maintain a fire 10 department. A city may establish fire limits and 11 may, consistent with code standards promulgated by 12 nationally recognized fire prevention agencies, 13 regulate the storage, handling, use, and transportation 14 of all flammables, combustibles, and explosives within 15 the corporate limits and inspect for and abate fire 16 hazards. A city may provide conditions upon which 17 the fire department will answer calls outside the 18 corporate limits or the territorial jurisdiction 19 and boundary limits of this state. A city may 20 require a public utility that supplies water to the 21 city or an entity with which the city contracts for 22 the provision of water to the city to install and 23 maintain an operational and centrally located fire 24 hydrant or an emergency water supply facility that is 25 available to emergency responders. A city has the same 26 governmental immunity outside its corporate limits when 27 providing fire protection as when operating within the 28 corporate limits. Fire fighters operating equipment 29 on calls outside the corporate limits are entitled 30 to the benefits of chapter 410 or 411 when otherwise 31 qualified. > 32 2.
