Page 20, after line 34 by inserting: 4 < DIVISION ___ 5 OPEN ENROLLMENT —— EXTRACURRICULAR ACTIVITIES 6 Sec. ___. Section 282.18, subsection 7, Code 2016, 7 is amended to read as follows: 8 7. a. A pupil participating in open enrollment 9 shall be counted, for state school foundation aid 10 purposes, in the pupil’s district of residence. A 11 pupil’s residence, for purposes of this section , means 12 a residence under section 282.1 . 13 b. (1) The board of directors of the district of 14 residence shall pay to the receiving district the state 15 cost per pupil for the previous school year, and the 16 teacher leadership supplement state cost per pupil for 17 the previous fiscal year as provided in section 257.9 , 18 plus any moneys received for the pupil as a result of 19 the non-English speaking weighting under section 280.4, 20 subsection 3 , for the previous school year multiplied 21 by the state cost per pupil for the previous year. If 22 the pupil participating in open enrollment is also an 23 eligible pupil under section 261E.6 , the receiving 24 district shall pay the tuition reimbursement amount to 25 an eligible postsecondary institution as provided in 26 section 261E.7 . 27 (2) If a pupil participates in an extracurricular 28 activity in accordance with subsection 11A, the 29 district of residence may deduct an activity fee from 30 the amount calculated in subparagraph (1). The amount 31 of an activity fee shall not exceed the lesser of the 32 actual cost of providing the activity to the pupil or 33 fifteen percent of the state cost per pupil for the 34 previous school year. 35 -1- S5157.3787 (1) 86 tm/rn 1/ 2 #1.

Sec. ___. Section 282.18, Code 2016, is amended by 1 adding the following new subsection: 2 NEW SUBSECTION . 11A. A pupil participating in 3 open enrollment for purposes of receiving educational 4 instruction and course content primarily over 5 the internet in accordance with section 256.7, 6 subsection 32, paragraph “c” , may participate in any 7 extracurricular activities offered to children in the 8 pupil’s grade or group and sponsored by the district of 9 residence under the same conditions and requirements as 10 the pupils enrolled in the district of residence. > 11 2.
