Section
97A.3,
subsection
3,
paragraphs

a
and
b,
Code
2016,
are
amended
to
read
as
follows:

a.
As
used
in
this
section
,
unless
the
context
6
otherwise
requires,
“reemployed”
or
“reemployment”
7
means
the
employment
of
a
person
by
the
state
or
in
8
a
position
which
would
otherwise
be
included
as
a
9
membership
position
under
subsection
1
,
after
the
10
person
has
commenced
receiving
a
service
retirement
11
allowance
under
section
97A.6
.
12
b.
(1)
If
a
person
is
reemployed,
the
person
13
shall
not
become
an
active
member
of
the
system
14
upon
reemployment
if
applicable
,
and
the
person
15
so
reemployed
and
the
state
of
Iowa
shall
not
make
16
contributions
to
the
system
based
upon
the
person’s
17
compensation
for
reemployment.
18
(2)
A
person
who
is
so
reemployed
shall
continue
to
19
receive
the
service
retirement
allowance
subject
to
the
20
requirements
of
this
subparagraph
(2)
,
and
the
service
21
retirement
allowance
shall
not
be
recalculated
based
22
upon
the
person’s
reemployment.
Notwithstanding
any
23
provision
to
the
contrary,
a
person
who
is
reemployed
24
shall
have
the
person’s
service
retirement
allowance
25
reduced
by
a
dollar
for
each
dollar
the
person
earns
as
26
a
result
of
the
reemployment.
Notwithstanding
section
27
97B.1A
or
any
other
provision
of
law
to
the
contrary,
a
28
person
reemployed
as
provided
in
this
subsection
shall
29
be
exempt
from
chapter
97B
.

Sec.
2.
Section
97B.48A,
Code
2016,
is
amended
by
31
adding
the
following
new
subsection:

.
6.
Notwithstanding
any
provision

of
this
section
to
the
contrary,
if
a
member
who
has

bona
fide
retirement
under
this
chapter
is
employed

be
reduced
by
a

Code

is
amended
by

striking
the
section
and
inserting
in
lieu
thereof
the

following:

survivor,

annuity
under
this
chapter
is
employed
as

a
state
officer
or
employee
during
a
calendar
year,

the
person’s
annuity
shall
be

while
employed
as
a
state

officer
or
employee.
