Senate File 2266 S-5054 Amend Senate File 2266 as follows: 1 1. By striking everything after the enacting clause 2 and inserting: 3 < Section 1. Section 97A.3, subsection 3, paragraphs 4 a and b, Code 2016, are amended to read as follows: 5 a. As used in this section , unless the context 6 otherwise requires, “reemployed” or “reemployment” 7 means the employment of a person by the state or in 8 a position which would otherwise be included as a 9 membership position under subsection 1 , after the 10 person has commenced receiving a service retirement 11 allowance under section 97A.6 . 12 b. If a person is reemployed, the person shall not 13 become an active member of the system upon reemployment 14 if applicable , and the person so reemployed and 15 the state of Iowa shall not make contributions to 16 the system based upon the person’s compensation for 17 reemployment. A person who is so reemployed shall 18 continue cease to receive the service retirement 19 allowance during the person’s reemployment , and the 20 service retirement allowance shall not be recalculated 21 based upon the person’s reemployment. Notwithstanding 22 section 97B.1A or any other provision of law to the 23 contrary, a person reemployed as provided in this 24 subsection shall be exempt from chapter 97B . 25 Sec. 2. Section 97B.52A, subsection 1, Code 2016, 26 is amended by adding the following new paragraph: 27 NEW PARAGRAPH . d. Effective July 1, 2016, the 28 member does not return to any employment with the 29 state. 30 Sec. 3. Section 411.3, subsection 3, paragraph a, 31 Code 2016, is amended to read as follows: 32 a.
