NEW SECTION . 728.2A Dissemination by 3 young persons of material depicting a sex act or nudity. 4 1. Any person fourteen through eighteen years 5 of age who knowingly disseminates to another person 6 fourteen through eighteen years of age material 7 depicting either or both persons, one of whom is a 8 minor, engaged in a sex act or in a state of full or 9 partial nudity, as defined in section 709.21, commits a 10 simple misdemeanor. 11 2. A person convicted under this section shall not 12 be required to register as a sex offender under chapter 13 692A. 14 Sec. ___. Section 728.12, Code 2016, is amended by 15 adding the following new subsection: 16 NEW SUBSECTION . 5. A violation of this section 17 does not apply to a person fourteen through eighteen 18 years of age if all of the following circumstances 19 apply: 20 a. The material was disseminated to a person 21 fourteen through eighteen years of age. 22 b. The material depicts the sender, recipient, or 23 both, one of whom is a minor, engaged in a prohibited 24 sex act or in the simulation of a prohibited sex act. 25 c. The material was knowingly created with the 26 consent of the persons depicted. 27 d. The sender of the material knows or reasonably 28 believes the material would not be offensive to the 29 recipient of the material. 30 e. The person does not further disseminate or 31 exhibit the material if the material depicts another 32 person. > 33 2.
