If the board 7 of supervisors adopts an ordinance pursuant to this 8 subsection, a petition meeting the requirements 9 specified in section 331.306 may be filed with the 10 board of supervisors within thirty days following 11 the effective date of the ordinance requesting that 12 the question of whether to continue to allow for the 13 use and explosion of fireworks be submitted to the 14 registered voters of the county. Upon receipt of a 15 valid petition requesting an election, the board of 16 supervisors shall direct the county commissioner of 17 elections to put the proposal on the ballot for the 18 next general election. If the ballot proposal is 19 rejected, the use and explosion of fireworks shall be 20 prohibited in the county. > 21 2. If the council adopts an ordinance pursuant to 27 this subsection, a petition meeting the requirements 28 specified in section 362.4 for petitions authorized by 29 city code may be filed with the clerk within thirty 30 days following the effective date of the ordinance, 31 requesting that the question of whether to continue 32 to allow for the use and explosion of fireworks be 33 submitted to the registered voters of the city. Upon 34 receipt of a valid petition requesting an election, 35 the council shall direct the county commissioner of 36 elections to put the proposal on the ballot for the 37 next regular city election. fireworks in a county, outside of the boundaries of all 1 cities in the county, only if the county has adopted an 2 ordinance to permit such use in accordance with section 3 331.301, subsection 16A, provided that such use is not 4 prohibited following a vote of eligible electors under 5 that subsection. 6 (2) A person may use or explode consumer fireworks 7 in a city only if the city and the county in which the 8 person is located have adopted ordinances to permit 9 such use in accordance with section 331.301, subsection 10 16A, and section 364.2, subsection 6, provided that 11 such use is not prohibited following a vote of eligible 12 electors under that subsection. 13 (3) A person who uses or explodes consumer 14 fireworks in a location where such use is not permitted 15 by the necessary ordinances under this paragraph “0b” 16 commits a simple misdemeanor, punishable by a fine of 17 not less than two hundred fifty dollars. > 18 6.
